AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington,
by the construction,of an irrigation system, establishing a Local Improve-
ment District, providing for the method of payment therefor, and creating
a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That an irrigation system shall be constructed to serve all of
the lots and tracts of land included within the following described district;
Lot 7, Young's Plat unrecorded;
North 62 Feet of Lot 1, Menjanker Subdivision;
South 26 feet of Lot 2 and North 36 feet of Lot 3, Menjanker
Subdivision;
South 41 feet of Lot 3 and North 21 feet of Lot 4, Menjanker
Subdivision;
Lots 22 to 29 inclusive, Subdivision of Tracts 13 and 14, Chase
Hill Residence Tracts;
Beginning at the Northwest corner of Lot 8 Young's Plat Unrecorded,
thence North along the East line of 24th Avenue South to the Naches
and Cowiche Ditch; thence Southeasterly along the Naches and Cowiche
Ditch to the West line of 22nd Avenue South ; thence South along the
West line of 22nd Avenue South to the Northeast corner of Lot 1,
Menjanker Subdivision; thence West along the North line of Menjanker
Subdivision to 23rd Avenue South ; thence North al ong 23rd Avenue
South to the North line of Young's Plat unrecorded; thence West
along said North line to the point of beginning,
said improvement to consist of the construction of the necessary headworks, mains, later-
als, service connections and other appurtenances for the purpose of delivering water for
irrigation purposes to each lot an d tract within the proposed district.
Section 2. There is hereby created and established a Local Improvement
District, to be called "Local Improvement District No. 793 which said district shall
include all of the property described and set forth in Section 1 hereof.
Section 3. The cost and expense in connection with the making and construc-
tion of said improvement, including the cost of acquiring right of way easements, engi.
neering, surveying, inspection, advertising, publication of notices and all other expens-
es incident thereto, except one - fourth (�-,,) the cost of the headworks, shall be levied and
assessed upon all of the property embraced within said Local Improvemenn District, in
accordance with the special benefits conferred thereon, in the manner provided by the
laws of. the State of Washington, and the ordinances of the City of Yakima; and said City
shall be liable only for one- fourth of the cost of the headworks.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings Which have been pre-
pared by the City Engineer, filed with the City Clerk, and which are hereby approved and
adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done by the Irrigation Department of the City of
Yakima.
Section 6. There is hereby created a special fund to be called "Local
Improvement District Fund, District No. 793 ", into which shall be placed all sums on ac-
count of the aforesaid special assessments, including all interest and penalties thereon;
and, in the event of the sale of Local Improvement Bonds by said City, all premiums and
interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4% per annum payable on
or before 12 years from the date of issuance, shall be issued in payment of the cost and
expense of said improvement, which bonds shall re redeemed by the collection of. special '
assessments to be levied and assessed upon the property within said district, payable in
10 equal annual installments, with interest at the rate of 4% per annum, interest payable
annually, under the mode of "Payment by BondsT", as defined by the statutes of the State
of. Washington and the ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or assess-
ments therefor; and shall become effective immediately upon its passage, approval and
publication as provided by City Charter.
