AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington,
by constructing a Portland Cement concrete sidewalk five feet in width;
establishing a Local Improvement District, providing for the method of pay-
ment therefor and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:

Section 1. That the East side of 20th Avenue South from Bonnie Doon Avenue
to Nob Hill Boulevard, shall be improved by constructing a Portland cement concrete side-
walk five (5) feet in width, and by doing all such other work as may be necessary in con-
nection therewith, all in accordance with the plans and specifications therefor prepared
by the City Engineer, filed with the City Clerk, and which are hereby approved and adopt-
ed.
Section 2. There is hereby created and established a Local Improvement
District to be called "Local Improvement District No. 790" which district is situate in
the City of Yakima, Yakima County, Washington, and contains the following described real
estate, to -wit:
Lots 4 to 9 inclusive of Block 4, Johnson's corner subdivision,
and Lots 1 to 6 inclusive, of Block 5, Allan's Subdivision of
Lot 12 of. Allan's Acre Tracts, according to the recorded plats
thereof on file in the office of the Auditor of Yakima County,
Washington.
Section 3. All of the costs and expenses in connection with the making and
construction of said improvement, including the cost and expense of all engineering, in-
spection, advertising, publication of notices, and all other expenses incident thereto
shall be levied and assessed upon all of the property embraced within said Local Improve=
ment District in accordance with the special benefits conferred thereon in the manner pro
vided by the laws of the' State of Washington and the Ordinances of the City of Yakima,
and said City shall not be liable in any manner for any portion of said costs and expens--
of said improvement.
Section 4. All of the work necessary to be done in connection with the mak-
ing of said improvement shall be done by and made by contract upon competitive bids, and •
said City of Yakima shall have and reserve the right to reject any and all bids.
Section 5. There is hereby created a special fund, to be called "Local
Improvement Fund District No. 790 ", into which shall be paid all sums paid on account of
the aforementioned special assessment including all interests and penalties thereon, and
in the event of the sale of Local Improvement Bonds by this City, all premiums and inter-
est on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4 per cent per annum, pay-
able on or before 12 years from date of issuance, shall be issued. in payment of the cost
and expense of said improvement, which bonds shall be redeemed by the collection of
special assessments to be levied and assessed upon the property within said district, pay-
able in 10 equal annual installments, with interest at the rate of 4 per cent per annum,
interest payable annually, under the mode of "Payment by Bonds" as defined by the statute -
of the State of Washington and ordinances of the City of Yakima.
Section 7. This ordinance is one relating to local improvements or assess-
ments therefor and shall become effective immediately upon its passage, approval and pub-
lication as provided by the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 27th day of
September, 1954.
