ORDINANCE NO. B -1597
AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington,
by the construction of a domestic water system, establishing a local im-
provement district, providing for the method of payment therefor, and creat-
ing a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That property in the City of Yakima, Washington, shall be im-
proved by the construction of a domestic water system, with the necessary main, fire
hydrants, valves and other appurtenances for the purpose of supplying water for domestic
use; said improvements to serve the property, the boundaries of which are described as
follows:
Beginning at a point on the north line of Nob Hill Boulevard midway •
• between 33rd Avenue South and 34th Avenue South; thence northerly
along a line midway between said Avenues to the north line of the
East half of. the Southeast quarter of the Northeast quarter of
Section 27, Township 13:North, Range 18, E.W.M.; thence easterly
along said north line to a point midway between 32nd Avenue South
• and 33rd Avenue South; thence southerly along a line midway between
said Avenues to the north line of Nob Hill Boulevard; thence westerly
along said-north line to the point of beginning;
all of said improvements to be constructed in full accordance with the plans and specifi-
cations to be prepared by the Uity Engineer.
Section 2. There is hereby created and established a Local Improvement
District, to be called "Local Improvement District No. 7$$ ", which said district shall
ihclude all of the'pr'operty described and'set forth in"Section'l hereof.
Section 3. All of the cost and expense of said improvement, including the
cost of acquiring right of way easements, engineering, surveying, advertising, inspection
publication of notices and all other expenses incident thereto, shall be levied and
assessed upon all of the property embraced within the Local Improvement District, in
accordance with the special benefits conferred thereon; in the manner provided by the
Laws of the State of Washington and the Ordinances of the City of Yakima; and said City
shall not be liable in any manner for any portion of said costs and expenses of said im-
provement.
• Section 4. All of the work necessary to be done in connection with the
making of said improvement shall be done by the City of Yakima.
Section 5. There is hereby created a special fund, to be called "Local
Improvement Fund, District No. 7$$ ", into which.shall be paid all sums paid on account of
the aforementioned special assessment, including all interests and penalties thereon;
and. in the event of the sale of Local Improvement Bonds by the City, all premiums and
interest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4% per annum, payable on
or before 12 years from date of issuance, shall be issued in payment of the cost and
expense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property Iri said district, payable in
ten equal annual installments, with interest at the rate of 4% per annum interest payable
annually,under the mode of "Payment by bonds" as defined by the statutes of the State
of Washington and the Ordinances of the City of Yakima.
Section 7. This ordinance is one relating to local improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by the City Charter.
