B' -1595 AN ORDINANCE amending section 22 of the Penal Code, Ordinance No.A -236 and amending section 1 of Ordinance No. B - 1033, ao as to render it unlawful to maintain or permit any tree or shrub so as to damage a water pipe line or sewer line, and relating to and requiring the removal of such tree, trees and shrubs, • providing for recovery of costs of removal thereof by the City, creating a lien upon property affected, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 22 of the Penal Code, Ordinance No. A -236 passed on January 2, 1917, is hereby amended to read as follows: "Section 22. It shall be unlawful for the owner or occupant of any property in the City of Yakima to maintain or permit any tree or shrub, either on or in front of said property, the roots of which in any manner interfere with or cause the surface of the street or sidewalk to be upheaved or otherwise disturbed, or the roots of which in any manner interfere with, break; damage or destroy any water pipe line or sewer line." Section 2. Section of of Ordinance No. B -1033 passed on August 1, 1949, is hereby amended to read as follows: "Section 1.. That the owner of any property. within the City of Yakima upon which any tree, plant, shrub or vegetation, or any part thereof, grows in any way so as to overhang any public sidewalk or street or tends to impair or obstruct the free and full use of any sidewalk or street, or grows in such manner as to interfere with, break, damage or destroy any water pipe line or sewer line, and the owner of any property upon • which grass, weeds, shrubs, trees or other vegetation is growing or has grown and died and which constitutes a fire hazard, shall be required to remove such tree, shrub, vege- tation or part thereof upon notice as prescribed by this ordinance." Section 3. Any person convicted of violating any of the provisions of this ordinance, shall be deemed guilty of a' misdemeanor and shall be punished by a fine in any sum not exceeding three hundred dollars ($300.00) or by imprisonment in the city jail not exceeding ninety (90) days or by both such fine and imprisonment. Section 4. This ordinance is one to provide for the immediate preservation . of the public peace, property, health and safety and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, . approval, and publication, as provided by law and the City Charter.
