B -1594 • AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and construcing concrete curbs and gutters; establishing a Local Improvement District, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIM!.: Section 1. That Prasch Avenue from Seventh Avenue South to Eighth Avenue South shall be improved. by grading, ballasting, surfacing, and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. The property to be benefited by this improvement consists of the following: The South 14 feet of Lot 7 and all of Lots $ to 12, inclusive.` . of Block 1 of the Amended Plat of Pearson Subdivision; also Lots 1 to 6, inclusive, and Lots 16 to 21, inclusive, of the Rowley -Evans Subdivision, according to the recorded plats thereof on file in the office of the Auditor of Yakima County. Section 2. There is hereby created a Local Improvement District to be caller. Local Improvement District No. 786, which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the costs and expenses in connection with the making and •construction of said improvement, including the cost and expenses of engineering, inspec- tion, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner and as provided by laws of the State of Washington and the ordinances of the City of Yakima, and • said City shall not be liable in any manner for any portion of said costs and expenses of said improvement. Section 4. All of the aforesaid construction work shall be in accordance with the plans, specifications, profiles, maps and maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in co nnection. with the making of said improvement shall be'do ne and made by contract upon competitive bids; and the City shall have the power to reject any and all bids. Section 6. There is hereby created a special ' fund to be called "Local Improvement Fund, District No. 786 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City, all premiums and inter- est on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4% per annum, payable on or. before 12 years from the date of issuance, shall be issued in payment of the cost and expense of said improvement; ; which bonds shall be redeemed by the collection of special • assessements to be levied and assessed upon the property within said district, payable in 10 equal installments, with interest at the rate of 4 per cent per annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. Section $. This ordinance is one relating to local improvements or assess - ments therefor, and shall become effective immediately upon its passage, approval, and publication as provided by the City Charter.
