B -1593 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters: establishing a Local Improvement District., providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Nineth Avenue North from Willow Street to Fruitvale Boule- vard shall be improved by grading, ballasting, surfacing, and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. Thepro- perty to be benefited by this improvement consists of the following: Lots 1 to 5, Block 1; Lots 1 to 5, Block 2; Lots 1 to 5 Block 5; and Lots 1 to 5, Block 6; all in Fruitvale Addition to the City of Yakima according to the recorded plat thereof on file in the office of the Auditor of said Yakima County. Section 2. There is hereby created a Local Improvement District to be call- ed Local Improvement District No. 735, which said district shall include all of the pro- perty described and set Forth in Section 1 hereof. Section 3. All of the costs and expenses in connection with the making and construction of said improvement, including the cost and expense of engineering, inspec- tion, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner and as _provided by laws of the State of Washington and the ordinances of the City of Yakima, and said City shall not be liable in any manner for any portion of said costs and expenses of said improvement. 11 Section 4. All of the aforesaid construction work shall be in accordance with the plans, specifications, profiles, maps and detailed drawings which have been pre- pared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to.be done in connection with the making of said improvement shall be done and made by contract upon competitive bids; and the City shall have the power to reject any all bids. • Section 6. There is hereby created a special fund to be called "Local Improvement Fund, District No. 785 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City, all premiums and in- terest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per cent per - annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. Section $. This ordinance is one relating to local improvements or assess - ments therefor, and shall become effective immediately upon its passage, approval, and publication as provided by the City Charter.
