AN ORDINANCE declaring certain acts and transactions to be petit larceny and making
persons. guilty thereof disorderly persons, and prescribing a penalty there-
for, and declaring. an emergency.
BE IT • ORDAINED BY THE CITY OF YAKIMA:
- Section 1. Every person who, with intent to deprive or defraud. the owner
thereof, •

g (a) Steals or takes money or property or leads or drives away property of
2 another; or

(b) Obtains from the owner or another the possession of or title to any
A personal property by color or aid of any order for the payment or delivery
d of oroperty or money, or by color or aid of any fraudulent or false repre-
. • u sentation, personation, or pretense or by any false token or writing or by
m writing or by any trick, device, bunco game, or fortune telling; or
g (c) Having any property in his possession, custody, or control, as bailee,
E factor, pledgee, servant, attorney, agent, employee, trustee, executor.,
k administrator, guardian, or officer of any person, estate, association, or
'''corporation, or as a public officer, or a person authorized by agreement
or by competent authority to take or hold such possession, custody, or
%control, or as a finder thereof, secretes, withholds, or appropriates the
• same to his own use or to the use of any person other than the true owner
or person entitled thereto; or
(d) Having received any personal property by reason of a mistake, with
knowledge of such mistake, secretes, Withholds, or appropriates the same to
his own use or to the use of any person other than the true owner or person
entitled thereto;
with reference to money or property of a value of T WENTY FIVE DOLLARS (1325..00) or less,
steals the same and shall be guilty of petit larceny, and is hereby declared a' dis-
orderly person.
Section 2. Every person who, knowing such money or propertyto have been
so appropriated in violation of Section 1 of this ordinance, brings into this city, or
buys, sells, receives or aids in concealing, or withholding any property wrongfully
appropriated, either within or outside of this city, in such manner as to constitute
petit larceny under the provisions of this ordinance, or aids or the commission
of a petit larceny in any manner specified in this ordinance, shall be guilty of petit
larceny, and is hereby declared a disorderly person.

Section 3. The value of all instruments not having a market value, whether
issued or delivered or not, by which any claim, privilege, right, obligation, or
• authority, or any right or title to property, real or personal, is, or purports to be,
or upon the happening of some future event maybe, evidenced, created, acknowledged,
transferred, increased, diminished, encumbered, defeated, discharged, or affected shall
be deemed to -be the amount of money due thereon or secured to be'paid thereby and unpaid,
or which in any contingency might be collected thereon or thereby, or the value of the
property transferred or affected or the title to which is shown thereby, or the sum of
. which might be recovered for the want thereof, as the case may be. In every other case
not otherwise provided herein, "value" shall be deemed to mean market value.
Section t,.. Any person who shall violate or fail to' comply with any of the
provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon convic-
tion thereof, shall be punished by a fine in any sure not exceeding three hundred dollars
M00.00) , or by imprisonment in the city jail for a term not exceeding ninetrf (90) days,
or both such fine and imprisonment.
Section 5. This ordinance is one to provide for the immediate preservation
• of the public peace, property, health and safety, and an emergency is declared to exist
and this ordinance shall be in full force and effect immediately' upon its passage,
approval and publication as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 9th day of August,
