B -1562 • AN ORDINANCE providing for the licensing and bonding of tree removers, requiring permits for the removal; of trees, providing penalties, repealing Ordinance No. B -1559, and declaring an emergency. • BE IT ORDAINED BY THE CITY OF YAKIMA : Section 1. It 'shall be unlawful for any person, firm, or corporation, to fell, cut down, or remove a tree, or trees, on the property of another, or to carry on such tree removing business in said city, without first obtaining and having in effect an annual tree remover's license. Such license may be issued by the city clerk upon payment of an annual license fee in the sum of $50.00, payable in advance on January 1st of each year. Section 2. Each such licensee shall file with the city clerk a liability insurance policy or surety b providing for the payment of all liability claims which may be owing by him for damages to persons or property, in the sum of not less than 35,000.00 for injury or death iD one person, and not less than $10,000.00 for total damages caused by one accident, and not less than $5,000.00 for property damages caused by one accident, and further, conditioned to indemnify the said city against liability or loss for any damages caused by such tree removal operations. Section 3. As used herein the term "tree" shall be deemed to refer to every. tree in said city which is $ inches or more in diameter at a point 4 feet above the ground. -Section 4. It shall be unlawful for any person, firm, or corporation, in- cluding licensed tree removers and owners and occupiers of property, to top a tree or trees in all cases where such tree topping might obstruct any street, or to fell, cut down, or remove a tree, or trees, in all cases where such tree removal might obstruct any street, alley, sidewalk or parking strip, without first obtaining from the city building inspector a permit so to do and paying the sum of one dollar per tree as a permit fee, and in the event such tree removal might obstruct any street, also notify- ing the police department and fire department of said city as to the location thereof and the approximate time of felling the same, and without first topping such tree before felling the same in all cases where public safety reasonably requires such tree topping. Section 5. It shall be unlawful for any person, firm or corporation, in eluding licensed tree removers and owners and occupiers of property, to prune or trim a tree, or trees, in any case involving the cutting or removal of one or more limbs or branches more than 3 inches in diameter at any point in all cases where the same might obstruct any street, alley, 'sidewalk or parking strip, without first obtaining a permit so to do and paying the permit fee as provided in section 4 hereof. Section 6. The holder of such permit shall, after removal, trimming, or pruning of the tree, sweep the adjacent street and gutter and leave the same in a clean condition and shall so far as practicable remove all fallen portions of such tree. Section 7. If any provision of this ordinance of the application thereof to any person or circumstance is held invalid, the remainder of the ordinance and the application of such provisions to other persons and circumstances shall not be affected thereby. Section $. Any person who shall violate or fail to comply with any of the provisions of this ordinance, or who shall counsel, aid or abet any such violation or failure to comply, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine in any sum not exceeding three hundred ($300.00 dollars, or by imprisonment 'in the city jail for a term not exceeding ninety (90) days, or both. such fine and imprisonment. Section 9. Ordinance No. B -1559 passed on May 10, 1954 is hereby repealed. . Section 10. This ordinance is one to provide for the immediate preserva- tion of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its pass- age, approval and puplication as provided by law and the City Charter.
