B -1559 AN ORDINANCE providing for the licensing and bonding of tree removers, requiring permits for the removal of trees, providing penalties, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. It Shall be unlawful for any person, firm, or corporation, to fell, cut down, or remove a tree, or trees, on the property of another, or to carry on such tree removing business in said city, without first obtaining and having in effect an annual tree remover's license. Such license may be issued by.the city clerk upon payment of an anneal license fee in the sum of $50.00, payable in advance on January 1st of each year. Section 2. Each such licensee shall file with the city clerk a liability insurance policy or.surety bond providing for the payment of all liability claims which may be owning by him for damages to persons or property, in the sum of not less than $5,000.00 for injury or death to one person, and not less than $10,000.00 for total dam- ages caused by one accident, and not less than $5,000.00 for property damages caused by one accident, and further conditioned to indemnify said city against liability or loss for any damages caused by such iree removal operations. Section 3. It shall be unlawful for any person, firm, or corporation, in- cluding licensed tree removers and owners and occupiers of property, to fell, cut down, or remove a tree, or trees, in all cases where such tree removal might obstruct any street, alley, sidewalk or parking strip, without first obtaining from the city building inspector a permit so to do and paying the sum of one dollar per tree as a permit fee, and in the event such tree removal might obstruct any street, also notifying the police department and fire department of said city as to the location thereof and the approxi- mate time of felling the same, and without first topping such tree before felling the : same. The holder of such permit shall, after removal of the tree, sweep the adjacent street and gutter and leave the same in a clean condition and shall so far as practicable remove'all portions of such tree. Section 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the remainder of the ordinance and the application of such provisions to other persons and circumstances shall not be affected thereby. Section 5. Any person sho shall violate or fail to comply with any of the provisions of this ordinance, or who shall counsel, aid or abet any such violation or failure to comply, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine in any sum not exceeding three hundred N300.00) dollars, or • by imprisonment in the city jail for a term not exceeding niney (90) days, or both such fine and imprisonment. Section 6. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approv- al, and publication, as provided by law and the City Charter.
