ORDINANCE NO. B -155$

AN ORDINANCE reducing the city license fee or occupation tax levied upon every person en
gaged in or carrying on a telephone business, from 3% to 1% of the gross in
come from such business in the City of Yakima, repealing Ordinance No. B-
1550, passed on March 22, 1954, amending Ordinance No. B -579, passed on
December 1$, 1942, and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The 'City Commission does hereby declare that subsequent to the
expiration of the telephone franchise on April 22, 1954 an agreement has been reached
with the holder thereof, that a telephone franchise, providing, among other things, for a
continuation of the 2% telephone franchise tax in the City of Yakima effective from and
after April 22, 1954 will be placed on the ballot at the State primary election to be
held on September 14, 1954 for approval by the voters of said city.
Section 2. Ordinance No. B -1550 entitled "AN ORDINANCE imposing a business
and occupation tax upon certain businesses, occupations and privileges, namely the tele-
phone business, requiring a business license for the same, providing for the collection
thereof, defining offenses, and prescribing penalties." passed on March 22, 1954, is
hereby repealed, effective as of April 22, 1954, the same as though said Ordinance No.
B -1550 had never been passed, or approved.
Section 3. Section 5 of Ordinance No. B -95, passed and approved by the City
Commission on May 6, 1939, as amended by Ordinance No. B -579, passed on December 1$,
1942, is hereby amended to read as follows:
"Section 5. Occupations Subject to Tax - Amount: There are hereby levied
and shall be collected annual license fees or occupation taxes against the persons on
account of the business activities, and in the amounts to be determined by the applica-
tion of the rates against gross income, as follows:
"(a) Upon every person engaged in or carrying on the business of selling
or furnishing electric light land power, a fee or tax equal to three per cent (3 %) of the
gross income from such business in the City during his fiscal year next preceding the
tax year, for which the license is required; PROVIDED HOWEVER, that the minimum fee or
tax shall not be less than Two Hundred Fifty dollars (`'250.00) per tax year.
"(b) Upon every person engaged' in or carrying on a telephone business, a
fee or tax equal to one per cent(1%) of his total gross income from such business in
the City of Yakima during his fiscal year next preceding the tax year for which the
license is required, including that portion of.the long- distance revenue originating at
telephones located within the, corporate limits of the said City of Yakima credited to
the Yakima Exchange; and including directory advertising revenue; PROVIDED, HOWEVER,
that the minimum fee or tax shall not be less than Two Hundred Fifty Dollars (050.00)
per tax year; and PROVIDED, FURTHER that the license fee or occupation tax herein Levi-
ed shall be in addition to any payment required to be made by such person under any
franchise held by him in the City of Yakima."
Section 4. This ordinance is one to provide for the immediate preservation
of the public peace, property, health and safety and an emergency is declared to exist,
and this ordinance shall be in full force and effect immediately upon its passage,
approval, and publication, as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 10th day of May,
1954.

passed on March 22, 1954, amending Ordinance No. 3 passed on December 1$, 1942,
and declaring an emergency." as passed this 10th day of May, 1954 and that same has been
published as required by law.
