B -1555 AN ORDINANCE providing for the expenditure of funds not budgeted, for services and expens es in connection with the Lenox Avenue overpass and pertaining to court litigation in connection therewith and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That an emergency exists requiring an expenditure of an addition- al $9,000.00 to defray certain expenses incurred for legal and engineering services rend- ered and costs incurred in connection with the Lenox Avenue overpass and court litigation pertaining thereto; it appearing that funds therefor were not appropriated by or included in the 1954 budget, and that it was impossible at the time of making said budget to have reasonably foreseen the need for such additional moneys for such purposes. That it was contemplated that said expenses would be paid from the proceeds of sale of the $400,00001 Lenox Avenue overpass bond issue which. was heretofore approved by vote of the people, but the same has been unexpectedly and unavoidably delayed by an appeal to the State Supreme Court which has been taken by one intervening taxpayer and wife in the test case involv- ing the test case involving the legality of said bond issue. Section 2. The City Treasurer is hereby authorized, empowered, and directed to issue emergency warrants upon the city street fund for said purposes, in a sum not to exceed $4,359.60, upon the presentation of proper vouchers therefor, and including the following bills pending: Preston, Thorgrimson & Horowitz, $2,320.$$ Tunstall & Hettinger, 506.00 Elwood Hutcheson • 60.40 Section 3. The City Treasurer is also hereby authorized, empowered, and directed, pursuant to Resolution No. C -1116 adopted by the City Commission on April 12, 1954, to take and transfer from the City Street Fund to the Lenox Avenue overpass fund a sufficient sum for the payment and redemption of the. outstanding warrants heretofore • issued in the total sum of $4,640.40 upon the Lenox Avenue overpass fund which was creat- ed by Ordinance No. B -1470, said warrants having been heretofore issued for the purposes hereinabove stated. Section 4. That said city street fund shall be later reimbursed for all sums taken pursuant to this resolution as soon as possible after the issuance of said Lenox Avenue bond issue out of the proceeds of sale thereof. Section 5. This ordinance is one providing for the expenditure of funds not budgeted, and an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage, approval and publication as provided by law and the City Charter.
