(ORDINANCE NO. B -1552
AN ORDINANCE making the issuance of certain commercial instruments disorderly conduct;
and prescribing a penalty therefor.
BE IT ORDAINED BY THE CITY OF YAKIMA:_
Section 1. Any p',erson, who with intent to defraud, shall make, or draw, or
utter, or deliver to another person, firm or corporation, anty. check, draft, or order for
payment of money upon any bank', or other depository, knowing at the'time of such drawing
or delivery that the maker or drawer had not sufficient funds in or credit with said bank
or depository for the payment thereof in full upon its presentation, shall be guilty of
disorderly conduct. The word "credit" as used herein shall be construed to mean an
arrangement or understanding with the bank for the payment of such check, draft, or order.
Section 2. The uttering or delivery of such a check, draft, or order to
another person, firm or corporation without such fund or credit to meet the same shall be
prima facie evidence of an intent to defraud.
Section 3. Any person who shall violate or fail to comply with any of the
provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction
thereof, shall be punished by a fine in any sum not exceeding three hundred ($300.00)
dollars, or by imprisonment inithe city jail for a term not exceeding ninety (90) days, or
both such fine and imprisonment.
Section 4. This 'ordinance in one to provide for the immediate preservation
of the public peace, property, health and safety and an emergency is declared to exist.,
and this ordinance shall be inl full force and effect immediately upon its passage, approv-
• al, and publication, as provided by law and the - 'ity Charter.
