Traffic Code. This ordinance shall constitute the "Traffic Code" of the City of Yakima and may be cited as such. Section 2. Exercise of Police Power. This code shall be deemed an exercise -. of the police power of the City of Yakima and of the State of Washington for the preservation and protection of the public health, safety, morals and economic . i welfare, and all of its provisions shall be liberally construed for the accomplish- ° ' ment of that purpose.- - Section 3. Effect of Partial Invalidity. If any provision of this code or the ; application thereof to any person or circumstances is held invalid, the remainder of - the code and the application of- such - provision -to- other - persons -or circum- 1 stances shall not be affected thereby. Section 4. Existing Ordinances Repealed. That Ordinance No. B -131, passed and approved on February 26, 1936, and all amendments thereof, and all other . ordinances or parts of ordinances in so far as the same are inconsistent with the provisions of this code, be and the same are hereby repealed. Section 5. Repeal Does Not Revive Former Ordinances. The repeal by this code of any existing ordinance shall not revive any former ordinance heretofore repealed, nor affect any right existing or accrued or any action or proceeding already taken, except as in this code provided. Section 6. Offenses Under Former Ordinances Saved. Nothing contained in any provision of this code shall apply to an act done or omitted or to any offense i committed at any time before the day when this code shall become effective. Such act or omission shall be governed by, and any such offense shall be punished ac- cording to, the provisions of the ordinances existing when such act, omission or offense occurred in the same manner as if this code had not been enacted. , . Section 7. Number, Gender and Tense. Words and phrases used herein in the past, present or future tense shall include the past, present and future tenses; words and phrases used herein in the masculine, feminine or neuter gender shall - - ' the masculine, or plural shall include the singular and plural; unless the include the herein in t context thereof shall indicate to the contrary. Section 8. Existing Permits to Remain in Force. Except as otherwise pro - vided herein, all permits lawfully issued under the provisions of any ordinances repealed by this code shall remain in force and effect until the expiration thereof unless sooner surrendered or revoked, subject, however, to all other provisions of i this code. Section 9. Duty of Vehicle Owner. Every act or statement required to be made by the owner of any vehicle, or by the agent of such owner, shall be made or done by the owner in person, unless such owner is a company or corporation or otherwise incapable of acting in person, and if the same is made or done by the agent, the necessity thereof shall be stated and shown. Section 10. False Representation Prohibited. No person shall make a false i representation in any application, statement or report required by this code to by ` made. . .
