ORDINANCE NO. B -150$
AN ORDINANCE providing for the improvement of Lots 4, 5, and 6 of Philips Suburban Tracts,
by the construction of a peipe sewer with the necessary wye branches, man-
hole, flush tank and water connection therefor, establishing a local improve
ment district, provdiding for the method of payment therefor, and creating
a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the following described property in the City of Yakima, Washington,
shall be improved by the construction of a pipe sewer with the necessary wye branches,
manhole, flush tank and water connection therefor.
The district to be served by and assessed for the above described improvements is
described as follows, to -wit:
Lots 4, 5, and 6 of Philips Suburban Tracts, according to the
records on file in the office of the County Auditor, Yakima
County, Washington;
all of said improvements to be in accordance with the plans and specifications therefor
prepared by the City Engineer, passed, approved and on file with the City Clerk.
Section 2. There is hereby created and established a local improvement district
to be called "Local Improvement District No. 766";* which said district shall include all
of the property described and set forth in Section 1 hereof.
Section 3. All of the cost and expense of said improvement, including the cost of
acquiring right -of -way easements, engineering, inspection, advertising, publication of
notices, and all other expenses incident thereto, shall be levied and assessed upon all
of the property embraced within the Local Improvement District in accordance with the
special benefits conferred thereon in the manner provided by the Laws of the State of
Washington and the ordinances of the City of Yakima, and said City shall not be liable
in any manner for any protion of said costs and expenses of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance with the
plans, profiles, specifications, maps and detailed drawings which have been prepared by
the City Engineer, filed with the City Clerk, and which are hereby approved and
adopted.
Section 5. All of the work necessary to be done in connection with the making of
said improvement shall be done and made by contract upon competitive bids; and the City
shall have the right and power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local Improvement
Fund, District No. 766 ", into which shall be placed all sums paid on account of the
aforesaid..special assessments, including all interest and penalties thereon; and in the
event of the sale of Local Improvement bonds by this City, all premiums and interest on
said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on
or before 12 years from date of issuance, shall be issued in payment of the cost and
expense of said improvement, which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said district, payable in
10 equal annual installments, with interest at the rate of 4 per cent per annum, interes
payable annually, under the mode of "payment by bonds" as defined by the statutes of the
State of Washington and the ordinances of the City of Yakima.
Section $. This ordinance is one relating to local improvements or assessments
therefor, and shall become effective immediately upon its passage, approval and publicat-
ion as provided by City Charter.
