ORDINANCE NO. B -1505
AN ORDINANCE regulating street decorations and banners and amending Ordinance No. B -$10,
entitled TTAN ORDINANCE relating to and regulating the erection and mainten-
ance of advertising signs, billboards and banners in the City of Yakima;
regulating advertising on the street of the City, requiring a license for
bill posting, a bond and license for sign erectors, a permit for the erect-
ion of signes and bill boards and the inspection of such signs and billboards;
providing for license permit and inspection fees, fixing penalties for the
violation thereof and repealing Ordinance No. B -13$, passed and approved by
the City Commission November 14, 1913, and any and all ordinances amendatory
thereof," renumbering certain sections of said ordinance, and declaring an
emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The number of the second section 10, entitled "STREET DECORATIONS AND
BANNERS" of Ordinance No. B -810, passed and approved on September 29, 1947 and entitled
as shown in the caption hereof, is hereby changed to-Section 11, and the same is hereby
amended to read as follows :
"No street decorations, banners, flags or other ornaments, except the flag of the
United States of America, shall be suspended or projected over streets, alleys, or other
public property; Provided, that banners, flags or other street decorations may be
temporarily suspended or projected over streets or other public property if the same is
done according to the following regulations:

"1. No Street decoration shall be done, unless it be done, by street decorators
who are licensed and bonded as required by Section 3, 4, 5 and 6 of this ordinance as
amended, and whose bond insures::proper maintenance of said decorations and the removal
of same by the date named in the permit.
"2. No banners or other street decorations shall be erected until a permit there-
for shall have been issued by the building inspector subsequent to his approval of a
written application by the decorator.
"3. Across street banners may not be used for commercial advertising.
"4. If cables are stretched across the street to suspend banners or decorations,
said cables must be fastened to anchors constructed for that purpose and approved by the
building inspector as capable or safely resisting a stress of 1000 pounds for each cable
attached thereto.under the standards set up in the building code of Yakima. The weight
of no cable, including its attached decorations, shall exceed one pound per lineal foot.
The snow, ice and wind loads shall be estimated by the building inspector for each
occasion. The posible snow and ice load shall be assumed to be two pounds per lineal
foot of cable when the decoration consists of the ordinary evergreen ropes. Since it is
improbable that a full snow and ice load will obtain when there is a strong wind, the
greatest additional load due to wind will be assumed to be 22 pounds per lineal foot of
evergreenrope. The cable itself must be a flexible stranded cable whose breaking strengt
is 4000 pounds or more. The cable must be adjusted to have a certain minimum sag to be
determined by one of the following rules: (RULE 1). If the cable is approximately
uniformly loaded throughout its length, the uniform sag shall be determined by the
Formula 5 = D, where D = the deflection or sag in feet; S = length of span in feet;
W =. _ST reslltant of weight (decorations, snow and ice) and the wind in pounds per
foot of cable; T = tension on cable and fastenings in pounds. "T" will thus be 1000
pounds, the figure predetermined for safe fastenings. The factors of S and W will be
determined by the building insepctor under the rules of the building code upon evidence
supplied by the decorator and verified by the inspector. .
(RULE 2). If the loading of the cable is concentrated at a few spots, the stress in the
cable and fastenings shall be determined by the closed polygon method of stress analysis .
for three or more concurrent forces in equilibrium and the sag shall be such that the
stress on the fastenings shall not exceed 1000 pounds.
"5. The lowest point of any decorations over a street or public driveway shall hot
be less than 15 feet above such street or public driveway; but in no case shall decor-
ations obscure traffic lights, traffic signs, or directional signs of any kind.
Decorations over state highways shall have a minimum height of 20 feet.
"6. All suspension cables shall have strain insulators installed at each end and
a turnbuckle at one or both ends capable of safely resisting a strain of 1000 pounds.
Turnbuckles shall have a wire threaded through both eyes and the central nut to prevent
the nut from turning.
"7. All street decorations and banners shall be fastened to cables or other
approved supports in a safe manner to resist the forces of snow, ice and wind. In. case
any of the decorations or banners should fall or become dangerous, it shall be the res-
ponsibility of the decorator to make immediate repairs, and for this purpose he shall
leave his name, address and phone or that of his local agent with the building inspector
and with the police department.
"8. No decoration or banner extending across the street may have any of its fasten
ings attached to any vent peip, sign or sign fastening, fire escape, ladder, or street
light pole.
"9. If a street banner is fastened by a rope or cable at eadh of its four corners,
the maximum size for the banner sahll be 40 square feet, and said banner shall have
distributed perforations to the extent of five per cent of its gross area. Furthermore
the fastenings at the two lower corners shall be limited to cords with a maximum breaking
strength of 300 pounds.
"10. Street decorations and banners having electrical illumination of any nature,
shall be provided through electrical installations and connections which shall be subject
to the approval of the City Electrical Inspector.
"It is not intended that anything contained in this section shall make it illegal,
or require a permit for a building owner or tenant to decorate the face of his building
in a temporary manner with flags, pennants or bunting fastened against and parallel

with the face of his building with no appreciable projection into the street; provided,
said decoration is ten feet or more above the sidewalk and does not cover any doors or
other exits, and provided no printed advertising is displayed thereon, and provided t_
further that no flag staffs or other items of sufficient weight to injure, should they
fall on' pedestrians, are included in said decorations."
Section 2. The number of Section 11 of said Ordinance No B -$10 entitled
"ALTERATIONS" is hereby changed to Section 12.
Section 3. Section 6 of said Ordinance No. B -810 is hereby amended to read
as follows:
"Section 6. BOND: Before any license is granted under the terms of this
ordinance, the applicant shall execute and deliver to the City of Yakima, a
bond in the sum of 20,000.00 executed by the applicant and a surety company
authorized to do business in the State of Washington as surety, conditioned
that the applicant will keep and save harmless the City of Yakima, its offic = ':
ials, agents and employees from any and all claims, damages, judgments and
expenses which may arise from any negligence of the applicant, his agents,
servants,contractors, or employees, or any of them, in the erection, servic-
ing, removing, or maintaining of any sign, street decoration, or banner;
provided, however, that in lieu of the bond required herein, any licensee
hereunder may submit proof that the City of Yakima is covered by additional
insurance or is otherwise indemnified under any existing policy of public
liability for not less than 310,000.00 for personal injuries or death of
one person,; and a total of $20,000.00 for public liability and $5,000.00 for
property damage."
Section 4. This ordinance is one to provide for the immediate preservation
of the public peace, property, health and safety, and an emergency is declared to exist,
and this ordinance shall be in full force and effect immediately upon its passage,
approval, and publication, as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 26th day of October,
1953.

that same has been published as required by law.
