B -1492 AN ORDINANCE providing for the improvement of the alley from East Yakima Avenue to East - Chestnut Street, between South 6th Street and South 7th Street; by grading and paving with asphaltic concrete placed on a gravel base; establishing a Local Improvement District, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the alley from East Yakima Avenue to East Chestnut Street, between South 6th Street and South 7th Street, shall be improved by grading and paving with asphaltic concrete placed on a gravel base, to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. Section 2. There is hereby created and established a Local Improvement District to be called "Local Improvement District No. 763," which said district is described as follows: All lots in Block 131, Yakima and Huson's Addition, according to the official plat thereof as recorded in records of Yakima County Auditor. . Section 3. All of the costs and expenses in connection with the making and constru- ction of said improvement, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and said City shall not be liable in any manner for any protion of said costs and expense of said improvement. Section 4. All of the aforesaid construction work shall be in accordance with the plans, profiles, specifications, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract upon competitive bids; and the City shall have the right and power to reject any and all bids. Section 6. There is hereby created a specail fund to be called "Local Improvement • Fund, District No. 763," into which shall be placed all sums paid on account of the afore- said special assessments, including all interest and penalties thereon; and in the event of the sale of Local Improvement Bonds by this City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the cost and expense of said improvement, which bonds shall be redeemed by the collection of specail assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per cent per annum, interest payable annually, under the mode of "payment by Bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section $. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publicat- ion as provided by City Charter.
