AN ORDINANCE providing for the improvement of certain property by surfacing and construct- ing concrete curbs and gutters; establishing a Local Improvement District, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That 44th Avenue North from Summitview Avenue to Snowmountain Road, and Snowmountain Road, west from 44th Avenue North, shall be improved by surfacing and con- structing concrete curbs and gutters, and to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. The property to be benefited by this improvement consists of the following: The easterly 150 feet of the southerly 20 feet of Block 6; Lots 1, 2, 14, 15 and 16, Block 14; Lots 9 to 16 inclusive, Block 15; and Lots 1, 2, 3, 10, 11 and 12, Block 21; all in The Uplands; also Lots 1 to 6 inclusive; Lots $, 10, 12, 14, 16 and 1$; and Lots 20 to 2$ inclusive; all in Block 2, Gilbert Uplands, according to the official plats thereof. Section 2. There is hereby created a Local Improvement District to be called "Local Improvement District No. 762," which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington and the Ordinances of the City of Yakima, and said City shall not be liable in any manner for any portion of said cost and expense of said improvment. Section 4. All of the aforesaid construction work shall be in accordance with the plans, profiles, specifications, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk and which are hereby approved and adopted. k Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract upon competitive bids and the City shall have the power to reject any and all bids. S 6. There is hereby created a special fund to be called "Local Improvment Fund, District No. 762," into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City, all premiums and interest on said bonds issued for said improvment. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable o n or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per cent per annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. Section $. This ordinance is one relating to Local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and public- ation as provided by City Charter.
