HomeMy WebLinkAbout1953-B-1477 501_ ORDINANCE NO.B -1477 AN ORDINANCE amending Ordinance No. B -1059 entitled, "AN ORDINANCE relating to the production, handling, sale and disposition of fluid milk and flute milk products intended or used as such for human consumption; establishing standards and defining terms; providing for the grading and inspection of such products; providing for the creation of milk inspection units; provid- ing for the issuance and cancellation of certificates of approval, permits and licenses; defining the powers and duties of certain officers; defining offenses and prescribing penalties therefor; repealing Ordinance No. B -296 and amendments thereto"', and requiring certain tests for Brucellosis, common- ly known as Bang's Disease. . BE IT ORDAINED BY THE CITY OF YAKIMA: • • Section 1. That Ordinance No. B -1059 entitled as stated in the caption hereof, and the Washington State uniform Fluid Milk Act therein adopted, the same being Chapter 168 of the Laws of 1949, . and Chapter 15.36 Revised Code of Washington, are hereby amended by adding the following at the end of the second paragraph of Item lr of Section 7 of said statute: "All herds of cows or goats shall be tested for Brucellosis at least once every twelve (12) months by an accredited veterinarian. If any animal in such heard is found to be positive to the Bang's test, as shown by blood serum tests for agglut- inins against Brucella Abortus made in a laboratory approved by the Supervisor of the Division of Dairy and Livestock or the Bureau of Animal Industry of the State of Washington, the affected animal shall be removed from the premises and slaughter- ed within fifteen (15) days after receipt of a notice from the City health officer or the State Department of Agriculture to the effect that said animal is a reactor to the Bang's test. The remaining animals in the heard shall be retested not less than thirty (30) days or more than sixty (60) days from the date of the first test. A series of retests, with removal and slaughter of reacting animals, shall be con- tinued until the heard shall have passed three successive negative tests, or two negative milk ring tests within a year, at the above mentioned interval, computed from succeeding tests in which no reactors are found. If upon a final test, not less than six (6 ) months nor more than seven (7) months from the date of the last negative tests, no reactors are found in the herd, it shll be deemed a disease - free herd. . "No person shall sell, offer or expose for sale any fluid milk designated or re- presented to be 'Grade A' fluid milk with knowledge that such milk has been produced from a herd of cows or goats one or more of which are infected with Brucellosis, -commonly known as 'Bang's Disease' at the time such milk was produced, or with knowledge that all animals in such herd have not been tested and found free from Brucellosis at least once during the preceding twelve (12) months. The results of a test by a laboratory approved by the State Department of Agriculture of, the United States Bureau of Animal Industry of a blood sample drawn by an accredited veterinarian shall be prima facie evidence of the infection or non - infection of an animal in any presecution instituted for the fiolation of this ordinance. " No . processor of milk shall purchase, accept or receive any fluid milk from any herd or part thereof that is quarantined because of Bang's disease." Section 2. If any protion of this ordinance shall be declared invalid, it shall not affect the validity of the remainder of this ordinance. Section 3. This ordinance shall be in full force and effect thirty (30) days after its passage, approval and publication as provided by law and the City Charter.
