ORDINANCE NO. B -1475 .
AN ORDINANCE providing for the improvement of certain- property by grading, ballasting,
,surfacing and constructing concrete curbs and gutters; establishing a
'Local Improvment District, providing for the method of payment therefor, .
and creating a special fund. .
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section , 1. That Thirty -fifth Avenue South from Tieton Drive to West
Chestnut Street and West Walnut Street from Thirty -fifth Avenue South to South Hilicrest
Avenue shall be improved by grading, ballasting, surfacing and constructing concrete
curbs and gutters. The district to be served and benefited by and assessed for the above
'described improvement is situated in the City of Yakima, Yakima County, Washington and
described as follows, to -wit:
Lots 4 to 12, both inclusive, Heyduck Park; and lots 6 to 20, both
inclusive, Martin's Addition No. 1, according to the officail plats
thereof recorded in the office of the Auditor of Yakima County,
Washington, and the west half of the east half of the west half of
the southeast quarter of the southeast quater of Section 22, Township
13 North, Range 18 E.W.M.

Section 2. There is hereby created a Local Improvement District to be
called Local Improvement District No. 759 which said district shall include all of
the property described and set forth in Section 1 hereof,
Section 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of engineering, inspec-
tion, advertising, publication of notices and all other expenses incident thereto,
shall be levied and assessed upon all of the property embraced within said Local Improve-
ment District in accordance with the special benefits conferred thereon, in the manner
provided by the laws of the State of Washington and the Ordinances of the City of Yakima;
and said City shall not be liable in any manner for any portion of said cost ane expense
of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;;
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 759 ", into which shall be placed all sums paid_on account
of the aforesaid special assessments, including all interest and penalties thereon;. and,
in the event of the sale of Local Improvement Bonds by this City, all premiums and interm
est on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate 'of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement; which bonds shall be redeemed by the collection
of special assessments to be levied and assessed upon the property within said district,,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of "Payment by Bonds" as defined by the
statutes of the State of Washington and the ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or assess-
"' ments therefor, and shall become effectibe immediately upon its passage, 'approval and
publication as provided by City Charter.

1955.
