B -1Li?1 AN ORDINANCE to prevent the spread of the disease of rabies or hydrophobia; providing for the individual quarantine of dogs suspected of being infected with said disease; providing for the general quarantine of all dogs in the City of Yakima during any period when said disease is considered by the City Health Officer to be a hazard to the public health; providing for the impounding and destruction of any dogs running at large during the period of general quarantine; providing for the treatment or destruction of dumb animals bitten by a rabid dog; and providing a penalty for the violation of the provisions hereof; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. It shall be the duty of the City Health Officer to cause to be quarantined any dog within the City of Yakima which he has gounds to suspect of being infected with the disease of rabies or hydrophobia. The biting of a human being by a dog is specifically declared to be a ground for suspecting such animal to be so infected. Section 2. Any such individual quarantine shall be initiated by delivering to the owner or keeper of any such dog, a written notice of such quarantine which shall prescribe the duration of the same; provided that the period of said quarantine shall not exceed fourteen (14) days unless it shall be determined that the existence of such disease is present. The delivery of the notice of quarantine to an adult residing upon the premises where such dog is kept shall be considered as delivery of the notice to the owner or keeper. Any such dog so quarantined shall be impounded in the Yakima County Humane Society Pound, provided that, in the discretion of such City Health Officer, said animal maybe quarantined upon the remises of the owner or a licensed veterinarian during such time as the provisions of the quarantine are strictly kept. Section 3. Whenever rabies or hydrophobia is declared by the City Health Office to be a hazard to the publid health, it shall be unlawful for any owner, keeper or handler oa any dog to keep or harbor same within the City of Yakima, unless such dog be securely confined at all times by leash or kept in a tight enclosure from which such dog cannot excape. A ny dog found running at large in the City of Yakima during the said period shall be impounded, and unless claimed and redeemed by its owner within two (2) days after such impounding, may be humanely disposed -_;of by the proper authorities. Section 4. During the period of any quarantine made under the provisions of this ordinance, the .owner or keeper of any dog so quarantined shall not allow said dog to come in contact with any . other animal or person, or permit such dog to run at large on any street, or highway, or other property in said city, or unon the premises where quarantined unless said premises be enclosed by a secure fence, nor shall such owner or keeper remove or cause such dog to be removed from said premises without the consent of the City Health Officer. These restrictions shall continue until said dog shall have been released from quarantine. Any dog subject to these restrictions found running at large as defined herein or which has been removed from the premises upon which quarantined, shall be impounded and unless claimed and redeemed by its owner within two (2) days after the expiration of quarantine period, may be humanely disposed of by the proper authorit- ies. Section 5. Any dumg animal known to have been bitten or otherwise exposed to a rabid animal must be destroyed or given anti - rabies (Pasteur) treatment or confined for a period of not ,less than six (6) months, unless such exposed animal had been vaccinated against rabies not longer than six (6) months, but not less than thirty (30) days, prior to exposure, in which case such animal shall remain under surveillance for six ( 6) months. If anti- rabies (Pasteur) treatment is given to such exposed animal, confinement and surveillance . may be reduced to three (3) months following exposure. Section 6. Whenever rabies or hydrophobia is considered by the City Health Officer to be a hazard to the public health, such officer shall cause to be published a notice to that effect in the_off icial newspaper of the city for three (3) successive days, following which for a period not to exceed ninety (90) days after the date of the last publication of said notice the provisions of section (3) shall be applicable, provided that such City Health Officer shall have authority when in his hudgment an • e xtension of time is necessary to carry into effect the purposes of . this ordinance, to renew said period, by notice given in the manner provided in this section and to further thereafter and in the same manner continue said period until in his judgment the said general quarantine herein provided for shall be unneces sary. Section 7. If any section or sections of this ordinance shall be invalid, it shall not affect the validity of the other sections of this ordinance. Section 8. Any person, firm, or corporation violating any of the provis- ions of this ordinance shall, upon conviction thereof, be fined in any sum not exceeding three hundred ($300.00) dollars, or imprisoned in the City Jail for a period of not exceeding ninety (90) days. Section 9._ This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approval, and publication, as provided by law and the City Charter.
