ORDINANCE NO. B-1159
AN ORDINANCE providing for the improvement of certain property by grading, ballasting,
surfacing and constructing concrete curbs and gutters; establishing a
Local Improvement District, providing for the method of payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Twenty - Eighth Avenue South and Twenty - Ninth Avenue South
from Bonnie Doon Avenue to Nob Hill Boulevard shall be improved by grading, ballasting,
surfacing and constructing concrete curbs and gutters, and to be constructed in full
accordance with the plans and specifications prepared by the City Engineer and filed
with the City Clerk. The property to be . benefited by this improvement consists of the
following:
Beginning at the northeast corner of Lot 40, Shaver Addition
thence southerly and parallel with - 28th Avenue South to Nob
Hill Boulevard, thence westerly along Nob Hill Boulevard to
the southwest corner of Lot 42, Block 1, Shannon Homes, thence
northerly and parallel with 29th Avenue South to Bonnie Doon
Avenue, thence easterly along Bonnie Doon Avenue to the point
of beginning.
Section 2. There is hereby created a Local Improv rnent District to be
called Local Improvement District No. 756, which said district shall include all of the
property described and set forth in Section 1 hereof,
Section 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of engineering,
inspection, advertising, publication of notices and all other exam uses incident thereto,
shall be levied and assessed upon all of the property embraced within said Local
Improvement District in accordance with the special benefits conferred thereon, in the
manner provided by the laws of the State of Washington and the Ordinances of the City
of Yakima, and said City shall not be liable in any manner for any protion of said
cost and e spense of s aid improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk and shich are hereby approved .
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids,
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 756," into which shall be placed all sums paid on account
of the aforesaid special assessments, including all interest and penalties thereon;
and, in the event of the sale of Local Improvement Bonds by this City, all premiums and
interest on said bonds issued for said improvema nt.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement; which bonds sh all be redeemed by the collection
of special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of "Payment by Bonds " as defined by
the statutes of the State of Washington and the. Ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by City Charter..
