B -1458 AN ORDINANCE providing for the improvement of certain property by constructing a concrete pipe storm sewer; establishing as Local Improvement District; providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the north side of Summitview Avenue from the east line of 44th Avenue North to a point 885 feet east thereof, shall be improved by constructing a concrete pipe storm sewer with necessary appurtenances; and to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. The property to be benefited by this improvement consists of the following: . Lots 7 to 12 inclusive, Block 21, The Uplands, The West 25.6 of Lot 9, Block 22, The Uplands, Lots 10 to 12 inclusive, Block 22, The Uplands, according to the official plat thereof on file and of record in the office of the County Auditor, Yakima County, Washington. . Section 2. There is hereby created a Local Improvement District, to be called Local Improvement District No. 755, which said district _shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the cost and expense in connection with the making and construction of said improvement, including the cost and expense of engineering, inspect- - ion, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington and the Ordinances of the City �f Yakima;: and said City shall not be liable in any manner for any portion of s aid cost and expense of said improvement. Section 4. Ail of the aforesaid construction work shall be in accordance with the plans, profiles, specifications, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract upon competitiye bids; and the City shall have the power to rejs ct any and all bids. Section 6. There is hereby created a special fund, to b e called "Local Improvement Fund, District No. 755 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City,_all premiums and interest on said bonds issued forsaid improvement. , Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with = interest at the rate of 4 per cent per annum, interest payable annually; under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. , Section 8. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by City Charter.
