ORDINANCE NO. B -1457
AN ORDINANCE providing for the improver nt of the alleys in Block 311 and 391,. Capitol
Addition; and Block 413, in Bedker's Addition and Bedker's Second Addition;
by grading and paving the same with asphaltic concrete placed on a crushed
rock base; establishing a Local Improvement District, providing for the
method of payment therefor, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1.. That the alleys in Block 311 and 391, Capitol Addition; and
Block 413, in Bedker's Addition and Bedker's Second Addition; shall be improved by grad-
ing and paving the same with asphaltic concrete placed on a crushed rock base, to be
constructed in full accordance with the plans and specifications prepared by the City
Engineer and filed with the City Clerk.
Section 2. There is hereby created and established a Local Improvement.
District to be called "Local Improvement District No.. 754` whichs aid district is
described as follows: . -
All of Lots in Block 311 and 391, Capitol Addition, and all of the
lots in Block 413 of Bedker's Addition and Bedker's Second Addition.
Section 3. All of the costs and expenses in connection with the making and
construction of said improvement, including the cost and expense of all engineering,
inspection, advertising, publication of notices, and all other expenses incident thereto
shall be levied and assessed upon all of the property embraced within said Local Improve-
ment District' in accordance" with the special benefits conferred thereon in the manner
provided by the laws of the State of Washington and. the Ordinances of the City of Yakima;
and said City shall not be liable in any manner for any portion of said costs • and
expenses of Said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby w proved
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bid's;;
and the City shall have the right and power to reject any and all bids..
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 754.,," into Waich shall be placed all sums paid on account .
of the aforesaid special assessments, including all interest and penalties thereon; and
in the event of the sale of Local Improvement Bonds by this City, all premiums and
interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost . and expense of said improvement, which bonds shall be redeemed by the collection
of special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of. "payment by bonds" as defined by
the statutes, of the State of Washington and the ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this llth day of May,
1953.
