ORDINANCE NO. B -1442
AN ORDINANCE providing for the improvement, of property in the City of Yakima, Washington,
by the construction of a sewer; : establishing a Local Improvement District;
providing for the method of payment therefor; and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That property in the City of Yakima, Washington, shall be im - --
proved - .by the' construction °f a. pipe sewer with the necessary wye branches, manholes,,
flush tanks and water connections therefor; all which property is hereinafter more par-
ticularly described in Section 2 hereof; and by doing all such other work as may be
necessary in connection . therewith; all in accordance with the plans and specifications
therefor prepared by the City Engineer, passed, approved and on file with the City Clerk.
Section 2. There is hereby created and established a local improvement
district to be called"Local Improvement District No. `750 "; which said district is
described as follows:,
Beginning at the northwest corner of the intersection of Summitview
Avenue and 28th Avenue North; thence northerly along the west line of
28th Avenue North to the Nachos and Cowiche Canal; thence south - westerly
. along said canal to the east line of 29th Avenue North; , thence southerly
along said east line to the north line of SummitviewrAvenue; thence east-
' erly along said north line to the point of beginning.
Section 3. All. of the costs and expenses in connection with the making and
m nstruction of said improvement, including the cost and expense of all engineering,
inspection, advertising, publication of notices, and all other expenses incident thereto,
shall be levied and assessed upon all of the property embraced withinsaid Local Imrpvement
District; in accordance with the spacial benefits conferred thereon in the manner
provided by the laws of the State of Washington and the ordinances' of'the City of Yakima,
and said City shall not be liable in any manner for any protion of said costs and
expenses of said improvement.
Section 4. All of the work necessary to be done in connection with the
making of said, improvement shall be done by and made by contract upon competitive bids;
and said City of Yakima shall have and reserves the right to reject any and all bids.
Section 5. There is hereby created.a special fund, to be called 'Local
Improvers nt Fund District No. 750 ", into which shall be paid all sums paid on account of
the aforementioned spacial assessment, including al interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by this City, all premiums and intere-
st on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issucance, shall be issued in payment of the
cost and expense of said improvement; Which bonds shall be redeemed by the collection of
special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually under the mode of "payment of bonds" as defined by the
statutes of the State of Washington and the Ordinances of the City of Yakima..
Section 7. This ordinance is one relating to local improvements and
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved, this 30th day of March,
1953.
