ORDINANCE NO. B -1441 .. .
AN ORDINANCE amending Section 6 of Ordinance No. B -293, entitled: "AN ORDINANCE regulat-
ing and restricting the location of trades and industries; regulating and
limiting the use of buildings and premises; and the height and size of
buildings; providing for yards, courts and other open T aces; establishing
districts for said purposes, and providing for a board of adjustment, and
repealing Ordinances Nos. B -22, B -35, B -43, B -51, B -71, B -126, B -147 and
B- 172 ", as amended by Ordinances Nos. B -786, B -1021 and B -1128.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Section 6 of Ordinance B -293, passed and approved by the
City Commission on March 28, 1938, and entitled as set forth in the caption hereof ;; and
the amendments thereof by Ordinance No. B -786, passed and approved by the City Commission
on June. 2, 1947, and by Ordinance No. B -1021, passed and approved by the City Commission
on June 20, 1949, and by Ordinance No. B -1128, passed and approved by the City Commission
on April 10, 1950, be and the same is hereby re- amended to read as follows:
"Sec. 6. BUSINESS DISTRICT.
(a) The . following uses only are permitted in a Business District:
1. Any use permitted in the Residence Districts "A ", "B" and "C ".
2. Stores, wholesale or retail.
3. Office, business or professional
4. Bank.
5. Restaurant.
6, Service Station.
7. Police or Fire Station.
8. •Printing establishment.
9. Telephone exchange or telegragh office. .
10. Theater, dance hall, skating rink or other commercial amusement .
place, subject to the provisions of paragraph "c" hereunder.
11. Retail trade or shop or custom work or the making of articles
to be sold at retail on the premises.
12. Salesroom or storeroom for motor vehicles.
13. Garage with or without public repair shop.
14. Laundry, clothes cleaning or pressing.
15. Undertaking establishments and /or crematories.
16. The manufacture of steam for commercial use, provided the
installation of the boilers is approved by the American Board of.
Insurance Underwriters or its successors.
17. And other similar uses.
(b) Manufacturing clearly incidental to retail business lawfully conducted
on the premises and not prohibited in the Commercial District shall be
permitted in a Business District.
(c) No privately owned dance hall, roller skating rink, merry -go- round,.
Ferris- wheel, carnival or circus, may be permitted within any public park,
school ground or playground, or within five hundred feet of the property
line of any such park, school or playground.
(d) Beer parlors or taverns • shall be permitted in the Business District,
save and except that no place where beer is dispensed for consumption on
the premises shall be established in any Business District within five
feet of the boundary of any residential district.
Sec. 6A. LIMITED BUSINESS DISTRICT.
(a) The following uses only are permitted in a Limited Business District:
1. Any use permitted in the Residence Districts "A ", "B ", and "C ".
2. Retail stores excepting those dispensing alcoholic beverages for
consumption on the premises.
3 Office, business or professional.
4. "Financial Institutions.
5. Restaurant.
6. Service Station.
7. Printing establishment.
8. Theater.
(b) No merchandise or other goods.or products or containers shall be dis-
played outside of the building where such business is carried on nor
stored on the premises outside of any building thereon."
Section 2. This Ordinance daall become effective thirty (300 days after
its passage, approval and publication as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 30th day of
March, 1953.
