B -1434 AN ORDINANCE providing for the expenditure of funds, not provided for in the 1953 budget, for the purpose of employing a traffic survey consultant and declaring an emergency: ' BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That an emergency exists requiring the employment of a qua- lified traffic survey consultant, namely, J. W. Arch Boliong, to conduct a traffic survey of the city of Yakima, and to make fact finding reports and recommendations for improving traffic conditions in the City of Yakima. That said traffic survey, reports and recom- mendations shall cost not to exceed $1,164.00; that it was impossible at the time of making the 1953 budget to have reasonably forseen the need for such traffic survey, and for that reason funds therefore, were not included in said budget. Section 2. The Mayor and City Clerk are hereby authorized, empowered and directed to execute a contract for said traffic survey with J. W. Arch Boliong, in the form and according to the terms of the agreement hereto attached and made a part hereof. Section 3. The City Treasurer is hereby authorized, empowered and directed to issue emergency warrants upon the funds properly chargeable, therefor, to J. W. Arch Boliong, in payment for his services, in an amount not to exceed $1,164.00, said payment to be made at the times and in the amounts specified in the agreement hereto attached and upon the . presentation of proper vouchers. Section 4. This ordinance is one providing for the expenditure of funds not budgeted and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication, as provided by law, and the City Charter. BURNS City Clerk Mayor A G R E E M E N T THIS AGREEMENT made and entered into this 17th day of March, 1953, by and between the CITY OF YAKIMA, WASHINGTON, a municipal corporation, hereinafter termed first party, and J.W. ARCH BOLLONG, hereinafter termed second party, W I T H E S SET : H: That in consideration of the mutual promises and agreements herein con- tained, first part does hereby employ second party, and second party hereby agrees to perform services for first party under the following terms: Second party agrees to conduct a traffic survey for first party of traffic conditions in the city of Yakima, Washington, and to make fact finding reports to first party, consisting of general traffic problems, accidents, traffic congestion and relief therefrom, on street and off street'parking, traffic signals, including types, location, co- ordination, etc.; street marking; arterials;, loading zones; bus zones; ° non - parking areas. ;; one -way streets; railroad crossings; signs;, speed limits; common carrier and passenger routing; and all other matters and things pertinent to a complete traffic study and survey, with the object of improving traffic conditions in the city of Yakima, and recommending improvements or changes for the future needs of Yakima. Second party agrees to make a written report and recommendations to first party monthly during the term of this agreement. Second party agrees to commence his work hereunder on March 10th, 1953, and the employment shall continue for a period of six months, unless sooner terminated, as provided for herein. Second party agrees to devote his time, skill and attention to said employ- ment fora period of four days of each month, during said six months period, the s aid four days to be in the second week of each month. First party agrees to pay second party for said traffic study, survey and reports, the sum of $194.00 per month, payable on or before the 10th day of each month following the period of each month of the employment. First party agrees to furnish second party with such clerical assistance as second party may require and to make available to second party all of .it's records and files which will assist second party in the performance of this agreement. This employment may be terminated any time by the mutual agreement of the parties hereto. In the event of the disability of second party or second party's failure to complete said study and survey or to make the reports to first party herein provided for, the first party may terminate this agreement without notice and without liability to second party for services rendered or materials furnished.
