AN ORDINANCE providing for the improvement of the alley from Division Street to Haynes
Street between Queen Avenue and Twelfth Avenue South, by grading and paving
with, asphaltic concrete placed on a gravel base; establishing . a Local
Improvement District, Ir oviding for the method of payment therefor, and
creating a special fund.
BE IT_ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the alley from Division Street to Haynes Street between
Queen Avenue and Twelfth Avenue South, shall be improved by grading and paving with
asphaltic concrete placed on a gravel base, to be constructed in full accordance with
the plans and specifications prepared by the City Engineer and filed with the City Clerk.
Section 2. There is hereby created and established a Local Improvement
District to be called "Local Improvement District No. 745 ",. which said district is
described as follows:
Beginning at the intersection, of Twelfth Avenue South and Division Street,
thence easterly along Division Street to Queen Avenue, thence southerly
along Queen Avenue to Haynes Street, thence westerly along. Haynes Street
to Twelfth Avenue South, thence northerly along Twelfth Avenue South to
the point of beginning.
Section 3. All of the costs and expenses in connection with the making and
construction of said improvement, including the cost and expense of all engineering,
inspection, advertising, pp ulication of nth ices, and all other expenses incident thereto
shall be levied and assessed upon all of the property embraced within said Local.
Improvement District in accordance with the special benefits conferred thereon in the
manner it ovided by the Laws of the State of Washington and the Ordinances of the City of
Yakima; and said City shall not be liable in any manner for any protion of said costs .
and expense of said improvement.
111 S.ection 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
t " and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;
and the City shall have the right and power to reject any and all b ids.

Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No« 745 ", into which shall be placed all sums paid.on account
of the aforesaid special assessments, including all interest and .penalties thereon;
and in the event of the sale of Local Improvement Bonds by this City, all premiums and
interest on said bonds issued for said improvement,
Section 7.. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement, which bonds shall be redeemed by the collection
of special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments,, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of "payment of bonds" as defined by
the statutes of the State of Washington and the ordinances of the City of Yakima,
Section 8. This .ordinance is one relating to local improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 6th day of October,
1952.
