ORDINANCE NO. B -1391
AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington,
by the construction of a domestic water system, establishing a local
improvement district, providing for the method of payment therefor, and
creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
• Section 1. That property in the City of Yakima,.Washington, shall be
improved by the construction of a domestic water system, with the .necessary mains, fire
hydrants, valves' and other appurtenances for the purpose of supplying water for domestic
use; said improvements to serve the property, the coundaries of Which are described as
follows:
• -The Uplands:
Lots 7 - 13: Block 13
" 4 - 10 " 14. •

according to the official plat thereof on file and of record in the office:
of the County Auditor, Yakima. County, Washington;;

all of said improvementa to be constructed in full accordance with the plans and
specification' to be prepared by the City Engineer.-
Section 24 There is hereby created and established a Local Improvement,
District, to be called "Local Improvement District No. 743 ", which said district shall.
include all of the property described and set forth in Section 1. hereof.
Section 3. All of the cost and expense of said improvement, including
the cost of acquiring right of way easements, engineering, surveying, advertising, .
inspection, publication of notices and all other expenses incident thereto, shall be
levied and assessed upon all of the property embraced within the Local Improvement
District,, in accordance with the special benefits conferred thereon; in the manner.
provided by the laws of the State of Washington and the Ordinances of the City of
Yakima; and said City shall not be liable in any manner for any portion of said costs
and expenses_ of said improvement. •
Section 4. All of the work necessary to be done in connection with the
making of said improvement shall be done by the City of Yakima.
Section 5. There is hereby created a special fund, to be called "Local
Improvement Fund District No. 743 ",, into.which be paid all sums paid on account
of the aforementioned special assessment, including all interests and penalties thereon;
and in the event of the sale of Local Improvement Bonds by this City, all premiums and
. interest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement; which bonds shall be redeemed by the collection
of special. assessments to be levied and assessed upon the property within said
district, payable in 10 equal annual installments, with interest at the rate of 4 per
cent per annum, interest payable annually, under the mode of "payment by bonds as
defined by the statutes of the State of Washington and the ordinances of the City of
Yakima.
Section 7. This ordinance is one relating to local'improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by the City Charter.
