B -1379 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing a Local Improvement District, providing for the method of payment therefor, and creating a special fund. • BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Twenty -Fifth Avenue South from Tieton Drive to a point 650 feet south of Tieton Drive, shall be improved by grading, ballasting, surfacing and constructing concrete curbs and gutters, and be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. The property to be benefited by this improvement consists of the following: - Beginning at the intersection of the east line of Twenty -Fifth Avenue: South with the south line of Tieton Drive;, thence easterly along the south line of Tieton Drive 'a distance of 135 feet; thence southerly li parallel with Twenty =Fifth Avenue South a. distance of 650 feet; thence :.. westerly to a point 142 feet west of the west line of Twenty -Fifth Avenue South; thence northerly parallel with Twenty -Fifth Avenue South to the south line of Tieton Drive; thence easterly along said south line to the point of beginning. , Section a. There is hereby created a Local Improvement District to be called Local Improvement District No. 742, which said district shall include all of the property described and set forth in Section 1. hereof. Section 3. All of the cost and expense in connection with the making and construction of said improvement, including the cost and expense of engineering, inspection, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner r ovided by the laws of the State of Washington and the Ordinances of the City of Yakima, and said City shall not be liable in any manner for any portion. of said cost ane expense of said improvement. . Section 4. All of the aforesaid construction work shall be in accordance with the plans, profiles, specifications, and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract upon competitive bids= and the City shall have the power to reject any and all bids. . Section 6. Threr is hereby created a special fund to be called "Local Improvement Fund, District No. 742," into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds:bearing interest at the rate of 4 per cent per annum, payable on or. before 1a years from date of issuance,, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per cent per annum, interest payable annually, under the mode of "Payment by Bonds"` as defined by the statutes of the State of Washington and the Ordinances: of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by City Charter.
