B -1374 • • AN ORDINANCE providing for the improvement of the alleys in Biock 130, Juson's Addition and in Biock .48, Yakima; by grading and paving the same. with asphaltic concrete placed On gravel base; establishing a Local Improvement District, providing for the method of payment therefor, and creating a spedical fund. BE IT ORDAINED BY. THE CITY OF YAKIMA: • Section 1.. That the alleys in Block 130, Juson's Addition and in Block 48, shall be improved by grading and paving, the same with asphaltic concrete placed' .on a gravelbase, to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. Section 2.. There is hereby created and established a local Improvement . District to be called "Local Improvement District No. 740",, which said district is described as follows: All'. the lots: in Block 130, Huson ►s Addition and in Block 48, Yakima, • according . to the official plats thereof on file and of record in the office of the County Auditor, Yakima, County, Washington. • Section 3 All of the Costs. and expenses in connection with the making and. construction of said improvement, including the cost and expense of all engineering,. • inspection, advertising, publication of notices, and al 1 .other expenses incident• thereto shall. be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon in the manner provided by the laws of the State of Washington and the ordinances of the City • of Yakima; and said City shal 1 not be liable in any manner for any protion of said costs and expense of said imp' ovement. Section.4. All of the aforesaid construction work shall be in accordance with the plans, profile, specifications, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby moved and adopted. Section 5. All of the work necessary to be done in connection with the • making of said improvement shall be done and made by contract upon competitive bids; and the City shall have the right and power to reject any and all bids. Section, 6. There is hereby; created a special fund to b e called. "`Local Improvement Fund, District No. 740, "` into Which shall be placed all sums• paid on account of the aforesaid special assessments, including all interest and penalties thereon; and in the event of the sale of Local Improvement Bonds by this City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum payable on or before 12. years from date of issuance, shall_ be issued in payment of the cost and expense of said improvement, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per cent per annum, interest payable annually, under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by City Charter.
