ORDINANCE. NO... 8-1371
An ordinance providing for the improvement of certain ;r operty by grading, ballasting,
surfacing and constructing concrete curbs, and gutters; establishing .a
Local Improvement District; providing for the method of payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA: •
• Section 1. That Second Avenue South, Landon Avenue, Rock Avenue and Ledwich
Avenue from Lenox Avenue to Mead Avenue; . al'so Prasch Avenue from Broadway to Ledwich.
Avenue, and Logan Avenue from Broadway to Voelker Avenue shall be improved by grading,
surfacing and constructing concrete curbs and gutters, and tobe constructed in full
accordance with the plans and specifications prepared by the City Engineer and filed
with the City Clerk. The property tobe benefited by this improvement consists of the
following:
Beginning at a point on the south line of Lenox Avenue 142.5 feet east
of the east line of Broadway; thence easterly along Lenox Avenue to a point
140 feet east of Ledwich Avenue;; thence southerly and parallel with
Ledwich.Avenue to the north line of Lot 10 Hackett Subdivision Na. 2;
thence easterly along said north line to Voelker Avenue; thence southerly
to the north line of Lot 15 Homer Boggess Half Acre Tracts No. 1; thence
westerly a1 ong said north line to a point 140 feet east of Ledwich Avenue;
thence southerly and parallel with Ledwich Avenue to Mead Avenue, thence
westerly along Mead Avenue to a: point midway between Landon. Avenue and
First Avenue South; thence Northerly parallel with First Avemue South to
a point midway between Mead Avenue and Logan Avenue;: thence westerly
parallel with Logan Avenue to a point midway between First Avenue South
and Second Avenue South; thence southerly parallel with Second Avenue South
to Mead Avenue; thence westerly along Mead Avenue to a point midway
between Second Avenue South and Broadway;; thence northerly parallel with •
Broadway to a point midway between Mead A -venue and Logan Avenue; thence
westerly parallel with Logan Avenue. to Broadway; thence northerly along
Broadway to a point midway between Pras:ch A and Lenox. Avenue; thence
easterly a distance.of 142.5 feet; thence northerly parallel with Broadway
to point of beginning: '

Except from. the above described i district the following:
Lots. 13 to 18 of Forques Plat; the east half of Lots 16 to 20 and the west
half of Lots 21 to 25 of Hackett's Subdivision;; the east half of. lots 6
to 10 of Queen Anne Addition.
Section 2. There is hereby created a Local Improvement District to be
called Local Improvement District No. 729, which said district shall include all of, the
Ir operty described and set forth in Section 1, hereof.

Section 3. All. of the cost and expense in connection with the:making and
construction of said improvement, including the cost and expense of engineering, in-
spection, advertising, publication of notices. and all other expenses incident thereto,
shall be levied and assessed upon all of the property embraced within said Local
Improvement District in accordance with the apecial.. benefits conferred. thereon, in the
manner provided by the laws of the State of Washington and the Ordinances of the City
of•Yakima; and said City shall not be liable in any manner for any protion of said
cost and expense of said improvement.
Section 4. All of the aforesaid construction work shall be_ in accordance.
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 729 ", into which shall be placed all sums paid on account
of the aforesaid special assessments, including all interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by this City, all premiums and
interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement;, which bonds shall. be redeemed by the collection of
special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of °payment by bonds'"' as defined by the
statutes of the State of. Washington and the Ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved, this 26th day of May,
1952.
