ORDINANCE. NO. B -1366
AN ORDINANCE relating to animals or fowls at large, or found, in the City of Yakima,
contrary to any ordinance of the City of Yakima; providing for the taking
up, impounding, keeping, and disposition of such animals or fowls, fixing
the charges therefor and the disposition of money received in connection
therewith; providing for a City Pound and the maintenance thereof by the
Yakima County Humane Society, appointing a Poundmaster under Ordinance
No. A -268 as amended by Ordinance No. B -327, and Ordinance No. B -988, and
providing for payment and compensation to the said society, and amending
Section 2, of Ordinance No. A -268, entitled "AN ORDINANCE providing for
the licensing, impounding, redemption, selling and killing of dogs
bitches;, providing a penalty for the violation hereof and, repealing
Ordinances numbered 15, 30, 228,. 239 and 516 and all other ordinances and
parts of ordinances in conflict herewith."
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The Yakima County Humane Society shall have the right for a.
period of five years from the 1st day of January, 1952, subject, however, to the
termination of this privilege by the City Commission in the manner hereinafter provided
for, and it shall be the duty of said society for said period, to take into custody,
impound keep and dispose of any domestic animal or fowl running at large, or found, in
the City of Yakima, contrary to any ordinance of said City, and to maintain a pound for
the keeping os such animals.
Section 2. The said society shall keep a record of all such animals, which
shall contain a description of the animal, the place where, and the date when, taken
into custody.
Section.3. Any animal impounded because found running at large, or because
without a license, may be redeemed by the owner prior to the sale or destruction of
such animal, by paying all charges against the same.
Section 4. The fees for impounding, keeping and selling any animal, to be
paid upon redemption of such animal, shall be as follows:.
For impounding any horse, mule or any kind of cattle, each $2.00
For keeping any horse, mule, or any kind of cattle, each per day 1.00
For impounding any dog 1.00
For keeping any dog, per day .75
For impounding any hog, sheep, goat, or any animal not herein
specifically named 1.00
For keeping any hog, sheep, goat, or any
animal not herein specifically named, per day .75
Exterminating any animal excepting cats 1.00
Exterminating cats, each .50
In addition to the foregoing, any person redeeing any dog shall, prior to,
or at the time of, the redemption, take out a license for the same, unless such dog
shal -1 already have a license for the current year, and any person purchasing a dog at
any sale herein provided for shall promptly take out a license for the same.
A fraction of a day shall be deemed a full day, and a protion of day in
excess of any multiple of twenty -four hours, shall be deemed a day.
Section 5. At any time after any horse, mule, cattle, hog or other stock
animal shall have been impounded because found loose within the city limits, the Yakima
County Humane Society shall follow the procedure set out in the state laws relative to
the care and sale of estrays.
Section 6. After four days from the time of impounding may dog, such
animal, if unredeemed by the owner, shall become the props rty of the Yakima County
Humane Society.
Section 7. That Section 24 of Ordinance No A -268, passed and approved by
the City Commission on May 14, 1917, and entitled as set forth in the caption hereof,
be, and the same is hereby amended to read as follows:
"Section 2. The annual license fee is hereby fixed at the sum of $2.50
for each dog until January 1, 1953. From January 1, 1953:, the annual
license fee for each male dog- or spayed female dog is hereby fixed at
the sum of $2.50, and the annual license fee for each female dog is
hereby fixed at the sum of $5..00,, provided, however, that any person who
pays the required fee for any dog license on or before the 1st of March
of the year in which the same is due and payable, shal 1 b e entitled to
a discount of $..50 on said fee. For the prupose of this section, any
dog under the age of four months shall be considered a puppy which does
not require a license, and any dog over the age of four months shall be
considered a dog requiring a license. '
Section 8. The Yakima County Humane Society shall be entitled to and
shall receive the following fees and compensation for the services herein provided for:
1. All moneys received for impounding and selling any dog.
2.. All moneys received for the keeping of any animal.

All moneys received for dog licenses in the City of Yakima,
The City of Yakima shall sell the dog licenses hereinabove provided for,.
and the money collected from the sale of s aid licenses shall bepaid to the Yakima.
County Humane Society on or before the 10th day of each month commencing as of January
1, 1952.

Section 9. All moneys received by the Yakima County Humane Society, its
agents or employees, for dog licenses., shall be paid to the City Treasurer of the City
of Yakima within forty -eight hours from the receipt thereof.
Section 10. The Yakima County Humane Society shall employ„ and shall pay
at its own expense, suitable and necessary persons to perform the duties herein
prescribed. . •
Section 11. The City of Yakima shall not in any manner be liable by
reas :on of any act or acts done by the Yakima County Humane Society, or any of its
officers or employees, whether in the performance of the duties prescribed by this
ordinance,, or otherwise. .
Section 12. All privileges conferred upon the said Yakima County Humane
Society under the provisions of this ordinance are subject to cancellation and revocation
by the City Commission at any time, upon its own motion and without cause shown, which
revocation and cancellation shall be declared by the passage of an ordinance repealing
this ordinance; and all rights and privileges conferred hereunder shall cease and
terminate thirty days after the passage of such repealing ordinance.
Section 130 The Yakima County Humane Society shall, within thirty days
after the passage of this ordinance, file with the Clerk of the City of Yakima, its
written consent to the terms and provisions of this ordinance.; otherwise, all rights
and privileges hereunder granted shall be absolutely null and void, and this ordinance
shallbe . of no force or effect. .
Section 14. The Yakima , County Humane Society and its duly appointed humane
officers are hereby appointed Poundmaster to enforce the ordinances of the City of
Yakima relating to the licensing, impounding, redemption, selling, and , killing, of dogs
and bitches, estray animals, and animal nuisances. The Yakima County Humane Society
shall make investigations of complaints about violations of any city ordinances
relating to animals or fowls, and use its facilities and personnel in the enforcenE nt
of such city ordinances.
Section 15. Any ordinances., or parts of ordinances, insofar a an d to the
extent only that, the same maybe in conflict: herewith, are hereby repealed.
Section 16. This ordinance shall .go into effect and be in force thirty (30)
days from and after its passage, approval and publication, in accordance with the
provisions of the City Charter.
