REPEALCO BY ORDNANCE NO/ ORDINANCE NO. B -1330
AN ORDINANCE amending Section 6 of Ordinance No. 6 -239, entitled: "AN ORDINANCE
relating to health and sanitation; providing for and regulating the collect-
ion and disposal of garbage, refuse and dead animals in the City of
Yakima; regulating the operation of the City Dump and the City Incinerator;
providing penalties for the violation hereof;.repealing Ordinance No. A-619
and Section 103: of Ordinance No. A -205, and all other ordinances and parts
of ordinances in conflict herewith."
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Section 6 of Ordinance No. B -239, passed and approved by
the City Commission September 13, 1937, and entitled as set forth in the caption
hereof, be and the same hereby is amended to read as follows:
"Section 6.
A. For the purposes of regulating the collection of garbage and
refuse in the City of Yakima, there are hereby established two
known One to be nown as the "Residential Classification ",
and the other as the "Business Classification." The Residential
Classification shall include all pre mises occupied as a single family
housekeeping unit, either in dwelling houses, apartments or other
multiple residences not housing more than four residential units.
"Residential Unit" as used herein, is defined as a unit in which all
persons reside together as a single family, whether single or
multiple dwellings. The Business Classification shall include all
other premises.
B. The collection of all refuse in the Business Classification
shall be made only by licensed collectors, •hereinafter provided for.,
at rates to be agreed upon between such collector and the business
houses served by him; PROVIDED, however, that swill, as defined by
Ordinance No. A-1207, passed and approved April 21, 1930,'may be -'
collected from business houses in the manner in s aid ordinance provided.
C. (1) Refuse and garbage in residential classifications shall
hereafter be collected in reasonable quantities by the City of Yakima.
"Reasonable Quantities" as herein used, shall be construed to be the
weekly accumulation of garbage abd refuse from residential units and
yards; but shall not include trees, limbs nor branches, •unless tied in
bundles which can be readily handled by one man; and shall not include
rubbish nor debris except in minor quantities resulting from construction,
alteration, demolition, remodeling or landscaping of any property.
(a) There is hereby imposed for garbage and refuse collection
service in the R sidential Classification, a. charge of One Dollar ($1.00)
per month for ea'h residential unit in the City of Yakima; which charge
shall be paid bi- monthly in advance in the City Treasurer of the City
of Yakima, as follows:
The sum of $2.00, representing payment of two months' collection
service in advance, on or before the 10th day following the date
of first billing; and }$2.00 bi- monthly thereafter, which charge
shall be paid to the City Treasurer of the City of Yakima on or
before the 10th day following the date of billing; and there is
hereby imposed a further charge of 50, which shall .b be added to
all accounts delinquent. Accounts shall be delinquent if not
paid on or before the 10th day following the date of billing -.
(3) Collection service may be suspended for non - payment of
such accounts; but such suspension shall not relieve the person
owing such account from the duty of complying with the provisions
of this or other ordinances pertaining to garbage, refuse or
sanitation. Such suspension of service shall render the premises
where such collection service is suspended subject to condemnation
for lack of sanitary requirements, and the owner or person in
charge or possession of said premises shall be subject to
prosecution for maintaining a nuisance upon said premises.
(4) The charges herein provided maybe suspended by the City upon
suitable advance notice given to the Sanitation Department of the ,
City of Yakima of an intention to vacate any premises, for a
period of thirty (30) days or more. Prior to the resumption of
occupancy of such vacated premises, notice must be given to said
Department, so that such collection service may be resumed."
Section 2. This ordinances sh al lbecome effective thirty (30) days
after its passage, approval and publication as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 3rd day of
December, 1951.
