ORDINANCE NO. B.1328
AN ORDINANCE providing for the improvement of the alleys in Block 346, Bartholetts:
Addition and Capitol Addition; Blocks 392, 393 and 394, Capitol Addition
and Bedkerts Addition; and Block 1, First Nob Hill Addition; by grading
and paving the same with asphaltic concrete placed on a gravel base;
establishing a Local Improvement Distri ct, providing for the method
of payment therefor, and creating a special:fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the alleys in Block 356, Bartholet's Addition and
Capitol Addition; Blocks 392, 393 and 394, Capitol Addition and Bedkerts Addition; and
Block 1, First Nob Hill Addition; shall be improved by grading and paving the sE:me
with asphaltic concrete placed on a g ravelbase, to be constructed in full accordance
with the plans and specifications prepared by the City Engineer and filed wl. th the
City Clerk. .
Section 2. There is hereby created and established a. Local Improvement
District to be called "Local Improvement District No. 731 ", which said district is
described as follows:
All the lots in Block 356, Bartholetts Addition and Capitol
Addition; Blocks 392, 393 and 394, Capitol Addition and Bedkerts
Addition; and Block 1, First Nob Hill Addition.
Section 3. All of the costs and expenses in connection with the making
and construction of said improvement, including the cost and expense of all engineering,
inspection, advertising, publication of notices, and al 1 other expenses incident
thereto shall be levied and assessed upon all of the property embraced within said
Local Improvement District in accordance with the special benefits conferred thereon
in the manner provided by the Laws of the State of Washington and the Ordinances of
the City of Yakima; and, said City shall not be liable in any manner for any portion
of said costs and expense of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby
approved and adopted. .
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;
and the City shall have the right and power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 731 ", into which shall be placed all sums paid_on account
of the aforesaid Special assessments, including all interest and penalties thereon;
and in the event of the sale of Local Improvement Bonds by this City, all premiums and
interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of
the cost and expense of said improvement, which bonds shall be redeemed by the
collection of special assessments to be ]s vied and assessed upon the property within
said district,. payable in 10 equal annual installments, with interest at the rate of
4 per cent per annum, interest payable annually, under the mode of "payment by bonds"
as defined by the statutes of the State of Washington and the ordinances of the City.

Section 8. This ordinance is one relating to local "improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 3rd day of
December, 1951.
