ORDINANCE. NO. B -1327
AN ORDINANCE amending Section 1 of Ordinance No. B-1013, entitled 'AN ORDINANCE
amending Ordinance No. B -590, entitled: !AN ORDINANCE relating to the
licensing and supervision of "Places of R fuge ", defining terms, prescribing
the duties of officers in connection therewith, fixing fees; providing for
certain decisions, defining offenses and providing penalties; and declaring
an emergency', and declaring an emergency."
BE IT ORDAINED BY THE CITY OF YAKIMA: .
Section 1 . . That section 1 of Ordinance No. B -1013, passed and approved by
the City Commission on the 31st day of May, 1949, and entitled as•s et fm th in caption
hereof, be and the same is hereby amended to read as follows:
- .. "Section 1. That Sections 2, 3, 4 of Ordinance No. B-590, passed and
approved by the City Commission June 7th, 1943, and entitled as set forth
in the caption hereof, be and the same hereby are amended to read as
follows: ,.
'Section 2. From and after July 1, 1943, no person, firm or corporation
shall maintain or advertise the maintenance of ' any place of refuge within
the City of Yakima without applying for and receiveing from the City Clerk
of the City of Yakima a license for the :operation of such place of refuge;.
such license shall be issued annually on or before July 1 of each calandar
year, and shall-expire on June 30 of each calandar year. The fee for
such license shall be $10..00 per year; and in addition thereto, $1.00 per
bed, for each b ed furnished by the applicant.: for lodging purposes.'
'Section` 3. No license shall be issued to a place of refuge until the
location therefor has been approved`by the City Commission, and no such .
approval shall be given in any "A" residence di strict. Applications for
license hereunder shall be made to the Building Inspector and' approved by
the City Commission and shall be accompanied by the consent of such owners
or occupants of adjacent property as shall be required by the City
Commission or the Building Insector. Such license shall not be issued until
the premises sought to be .licensed have been inspected and approved by the
City Health Officer and the Chief of the Fire Department Of the City of
Yakima; and said premises shall be all respects comply with the Ordinances
of the City of Yakima relating to health and fire and also with the
Building Code. Said premises shall"be inspected at ]east quarterly by the
CitY Health Officer and the Chief of the Fire Department.'
'Section 4. The City Commission shall have the right to revoke a license
to any place of refuge if upon inspection thereof it is found to be
unsanitary or unsafe in condition as relates to health to fire, provided
that the City Commission shall notify the owner, -operator, or manager of
such place of refuge as to the proposed revocation of license, and shall
specify the conditions to be remedied to prevent such revocation. Such
notice shall provide a reasonable length of time in which the conditions
noted shall be remedied. Upon the revocation of any license as herein
provided, the right to occupy the premises as a place of refuge shall
immediately and automatically cease.'"
Section 2. This ordinance shallbe effective thirty (30) days after its;
passage, approval and publication as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved, this 26th day of
November, 1951.
