B -1319 AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington, by the construction of a domestic water system, establishing a local improvement district, providing for the method of payment therefor, and creating a special fund. BE IT•ORDAINED BY THE CITY OF YAKIMA: . Section 1. That property in the City of Yakima, Washington, shall be improved by the construction of a domestic water system, with the necessary mains, . fire hydrants, valves and other appurtenances for the prupose of supplying water for domestic use; said improvements to serve the property, the boundaries of which are described as follows: Beginning at the intersection of the east line of 25th Avenue South and the south line of Tieton Drive; thence. easterly along Tieton Drive a distance of 135 feet; thence southerly and parallel with 25th Avenue South to the north right of way line of the Naches— Cowiche Canal;. thence westerly along said right of way line to a point 142 feet west of 25th Avenue South; thence northerly and parallel with 25th Avenue Bouth to the south line of Tieton Drive; then easterly along said south line to the point of beginning; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer. Section 2. There is hereby created and established a Local Improvement District, to be called "Local Improvement District. No. 730 ", which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, inspection, publication of notices and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within the Local Improvement District, in accordance with the special benefits conferred thereon; in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and said City shall not be liable in any manner for any protion of said costs and expenses of said improvement. Section 4. All of the work necessary to be done in connection with the making of said improvement shall be done by the City of Yakima. . Section 5. There is hereby created a special fund, to be called "Local Improvement Fund District No. 730 ", into which shall be paid all sums paid on account of the aforementioned special assessment, including all interests and penalties thereon; and in the event of the sale of Local Improvement Bonds by this city, all premiums and interest on said bonds issued for said improvement. Section 6. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of ,4 per cent per annum, interest payable annually, under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 7. This ordinance is -one relating to local improvements or . assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the City Charter.
