ORDINANCE NO.
AN ORDINANCE providing for the improvement of certain property by grading, ballasting,
surfacing anc constructing concrete curbs and gutters; establishing a
Local Improvement District, p' oviding for the method payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Mulder Drive, Fifth Avenue South and Eight Avenue South,
from Stewart Street to Lenox Avenue shall be .improved by grading, ballasting, surfacing
and constructing concrete curbs and gutters, and to be constructed in full accordance
with the plans; and specifications prepared by the City Engineer and filed with.the
City Clerk. The property to be benefited by this improvement consists of the following:
Beginning at the intersection of 5th Avenue South and Lenox Avenue;
thence westerly along Lenox Avenue to a point midway between 5th
Avenue South and 6th Avenue South; thence northerly and parallel
with 5th Avenue South to Stewart Street; thence easterly along Stewart
Street to a point 135 feet east of 5th Avenue South; thence southerly
and parallel with 5th Avenue South to Lenox Avenue, thence westerly
along Lenox Avenue to the point of beginning.
Also beginning at the intersection of 8th Avenue South and Lenox
Avenue; thence westerly along Lenox Avenue to the southwest corner
of Lot 21 of Blackburns Half Acre. Tracts; thence northerly along
the west line of said Lot 21 to the southeast corner of Ninth Avenue
Addition; thence westerly along the south line of said addition to
9th Avenue South; thence northerly along 9th Avenue South a distance
of 204 feet; thence easterly and parallel with Mulder Drive to the
west line of Blackburns Half .Acre Tracts ; northerly along said
west line to Stewart Street; thence easterly along Stewart Street to
the northeast corner of Lot 15, Blackburns Half Acre Tracts, thence
southerly along the east line of Lots 15 and 26 of said addition to
Lenox Avenue, thence westerly along Lenox Avenue to the point of
beginning.
Section 2. There is hereby created a Local Improvement District to. be
called Local Improvement District No. 729 which said district shall include all of the .
property described and set forth in Section 1 hereof.
Sjection 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of engineering,
inspection, advertising, publication of notices and all other expenses incident thereto,
shall be levied and assessed upon all of the property embraced within said Local
Improvement District in accordance with the special benefits conferred thereon, in the
manner provided by the laws of the State of Washington and the Ordinances of the
City of Yakima; and said City shall not be liable in any manner for any protion of
said cast and expense of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans;, profiles, specifications maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said' improvement shall be done and made by contract upon competitive bids;
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 729 ", into which shall be placed all sums paid on
account of the aforesaid special assessments, including all interest and penalties
thereon; and, In the event of the sale of Local Improvement Bonds by this City, all
premiums and interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of-issuance, shall be issued in payment of tle
cost and expense of said improvement;; which bonds shall be ,redeemed by the collection
of special assessments to be levied and assessed-upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of "payment by bonds" as defined by
the statutes of the State of Washington and the Ordinances of the City of Yakima.
Section 8. This ordinance is one rel ting to local improvements or
assessments therefor, and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.
PASSED BY CITY COMMISSION, signed and approved, this 22nd day of
October, 1951.

Ordinance No. 3-1310 entitled "AN ORDINANCE providing for the improvement of certain

and creating a special fund. ", as passed on this 22nd day of October, 1951, and that
same has been published as required by law.
