ORDINANCE NO. B -1274
AN ORDINANCE providing for the improvement of the alley between 18th Avenue South
and 19th Avenue South, from Bell Street to Graham Street; the alley
in Block 6, Modern Addition; the alley in Block 3, Highland Addition;
and a portion of the alley in Block 291, Capitol Addition; by grading
and paving with asphaltic concrete on a gravel base; establishing a
Local Improvement District, providing for the method of payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE 'CITY OF YAKIMA:
Section 1. That the alley between 18th Avenue South and 19th Avenue
South, from Bell Street to Graham Street; the alley in Block 6, Modern Addition;
the alley in Block 3, Highland Addition; and a portion of the alley in Block 291,
Capitol Addition, shall be improved by grading and paving with asphaltic concrete on
a gravel base; all in accordance with the plans and specifications prepared by the
City Engineer and filed with the City Clerk.
Section 2. There is hereby created andestablished a Local Improvement
District, to be called Local Improvement District No. 724; which said district is to
include the property described as follows:
Lots 6 to 23, Buena Vista (unrecorded); Lots 1 to 20, Block 6,
Modern Addition; Lots 1 to 16, Block 3, highland Addition;
and Lots 4 to 8, Block 291, Capitol Addition.
Section 3. All of the costs and expenses in connection with the making
and construction ofsaid improvement, including the cost and expense of all engineering,
inspection, advertising, publication of notices, and all other expenses incident
thereto, shall be levied and assessed upon all of the property embraced within said
Local Improvement District; in accordance with the special benefits conferred there-
on in the manner provided by the laws of the State of Washington and the ordinances
of the City of Yakima; and said City shall not be liable in any manner for any portion
of said costs andexpenses of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby
approved and adopted. .
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids,
and the City shall have the right and power to reject any and all bids.
Section 6. There is hereby created a special fund, to be called "Local
Improvement Fund, District No. 724 "; into which shall be placed all sums paid on
account of the aforesaid special assessments, including all interest and penalties
thereon; and in the event of the sale of Local Improvement Bonds by this City, all
premiums and interest on said bonds issued for said improvement.
Section 7. -Bonds bearing interest at the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of
the cost andexpense of said improvement; which bonds shall be redeemed by the collect-
ion of special assessments to be levied and assessed upon the property within said
district, payable in 10 equal annual installments, with interest at the rate of 4 per
cent per annum, interest payable annually, under the mode of "payment by bonds" as
defined by the statutes of the State of Washington and the ordinances of the City of
Yakima.
Section 8. This ordinance is one relating to local improvements or,
assessments therefor, and shall become effective immediately upon its passage,
approval and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 6th day of August,
1951.

on this 6th day of August, 1951, and that same has been published as required by law.
