ORDINANCE NO. B -1267
AN ORDINANCE amending Section 71 -a of Ordinance No. B -131, entitled: "AN ORDINANCCE
relating to and regulating traffic, travel and transportation and their
incidents upon the streets and other ways open to the public; prescribing
the powers and duties of officers and others in relation thereto; defining
offenses, providing penalties and repealing certain ordinances concered
with or relating to the subject matter of this ordinance, and declaring
an emergency "; as amended by Ordinances No. B -571, B -726, B -956, B -1068,
B -1186, B -1192, B -1246, B -1247, and B -1261; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA: .
•
Section 1. That Section 71 -a of Ordinance No. B -131, passed and approved
by the City Commission on the 26th day of February, 1936, and entitled as set forth in
the caption hereof; as amended by Ordinance No. B -571, passed and approved by the City
Commission on the 1st day of September, 1942, as amended by Ordinance No. B -726,
passed and approved by the City Commission on the 3rd day of September, 1946, as
amended by Ordinance No. B -1186, passed and approved by the City : Commission on the 16th
day of October, 1950, as amended by Ordinance No. B -1192, passed and approved by the
City Commission on the 30th day of October, 1950; be and the same is hereby re- amended
to read as follows:
"Section 71 -a. Parking Meter Zones. That the following described portion
of the following named avenues and streets in the City of Yakima are here-
by established as Parking Meter Zones:
Both sides of Yakima Avenue from 6th Avenue to Naches Avenue; .
West side of 4th St., from A- St. to B St.;
. Both sides of 4th St. from A St. to Chestnut St.;
. Both sides of 3rd St. from B St. to Walnut St.;
Both sides of 2nd St. from C St. to Spruce St.;
Both sides of 1st St. from B St. to Spruce St.;
. East side, Front St. from A St. to Chestnut St.;
West side, Front St. from A St., South 210 feet;
Both sides of East A St. from Front St. to Naches Ave.;
. Both sides of East B St. from 1st St. to 2nd St.;
South side of East B St., from 3rd St. to 4th St.;
Both sides, East Chestnut St.'from Front St. to Naches Ave.;
Both sides, East Walnut St. from Front St. to 3rd St.;
West side,. North 2nd Ave., from Yakima Ave. to first alley;
West side, South 2nd Ave.., from Yakima Avenue to Chestnut St.;

Section 2. That Section 71 -a of Ordinance No. B -131, passed and approved
by the City Commission on the 26th day of February, 1936, and entitled as set forth in

Both sides, 1st St. from B St. to Spruce St.;
Both sides, 2nd. St. from B St. to Walnut ,St.;
Both sides, 3rd St. from A St. to Walnut St.;
Both sides, 4th St. from A St. to Chestnut St.;
West side, North 2nd Ave. from Yakima Ave. to first alley;

The following described portions of the following named avenues and
streets in the City of Yakima are hereby established as fifteen
minute parking•meter zones:
West side South 2nd Ave., from Yakima Ave. to a distance south of
Yakima Ave., 60 feet.
• Section 71 -a3. Thirty minute parking meter zones:
The following described portions of the following named avenues and
streets in the City of Yakima are hereby established as thirty minute
parking meter zones:
1st meter, South Front and Yakima Avenue on Front St.;
1st meter, North Front and Yakima Avenue on Front St.;
1st and last meters on North and South sides of Yakima Ave., -
Front to 1st St.;
1st and last meters on North and South sides of Yakima Ave.,
from 1st to 2nd St.;
1st and last meters on North and South sides of Yakima Ave.,
from 2nd to 3rd St.;
1st and last meters on North and South sides of Yakima Ave.,
from 3rd to 4th St.;
1st and last meters on North and South sides of Yakima Ave.,

• Section 3. That Section 71 -d of Ordinance No. B -131, passed and
approved by the City Commission on February 26, 1936, and entitled as set forth in
the caption hereof; as amended by Ordinance No. B -571, passed and approved by the City
Commission on the 1st day of September, 1942; as amended by Ordinance No. B -956, passed
and approved by the City Commission on December 6, 1948; as amended by Ordinance No.
B -1186, passed and approved by the City Commission on October 16, 1950; be and the
same is hereby rare nded to read as follows
� 'Section 71 -d. Use of Parking Meters.
th o%' Between the hours of 8 :00 o'clock A.M. and 6 :00 o'clock P.M., on all,
of days except Sunday, New Year's Day, Washington's Birthday, Memorial
o .. Day, t'ourth of July, Labor Day, Thanksgiving Lay, and Christmas Day;
� °Y4- when any vehicle shall be parked in any space alongside of or next to
P cA which a parking meter is located, in accordance with the provisions of
this Ordinance; the operator of said vehicle or the person in whose
name the vehicle is registered, shall, upon entering said space with
said vehicle, immediately deposit in said meter a one -cent coin of the
United States, or a five -cent coin of the United States, for a legal
parking time and amount designated by said meter, and put the meter in
operation; unless said parking meter is covered by a locked meter hood,
as hereinafter provided. -
If said vehicle shall remain parked in said parking space beyond the
legal parking time which shall be designated by a sign or signal of
said parking meter showing illegal parking, such vehicle shall be
considered as parked over -time; and the parking of a vehicle over -time,
or failure to put said meter in operation, shall be a violation of
this ordinance, and be punished as hereinafter set forth.
Section 71 -d1. A meter hood may be obtained by filing a written
application therefor with the Commissioner of Public Works of the
City of Yakima; which application shall state the name and address of
the applicant; a statement as to the business in which applicant is
engaged; and a description of applicant's trucks or automobiles used
in the conduct and operation of applicant's business. The Commissioner
of .Public Works shall refer said application to the Chief of Police of
the City of Yakima.
Section 71 -d2. It shall be the duty of the + Chief of Police of the
City of Yakima to investigate the facts stated in the application;
and to determine the necessity for the use of the meter hood in con-
ducting or operating the'b usiness of the applicant.

Section 71 -d3. Upon the approval of the application by the

4o �ion 71 -d4. The rental charge for the use of said meter hoods
0 0• s. hereby established at $6.00. per month for a period of 30 days
a���� ol. from date of issuance of hood, or 6.0.00 per year; all rental fees
4$o Section 71 -d5. It shall be unlawful for any person, firm or
corporation to use a meter hood in any 15- minute or 30- minute
parking meter zone.
Section 71 -d6. It shall be unlawful to use any meter hood,
when the rental on said hood remains unpaid.
Section 71 -d7. It shall be unlawful to use a meter hood, or to
allow the same to remain upon a parking meter, unless the parking
space adjacent to said parking meter is occupied by a motor
vehicle. •
Section 71 -d8. In the event of the surrender of -a meter hood by
• the renter, or the repossession thereof by the Police Department;
there shall be deducted from the $5.00 deposit for each meter
hood the following amounts, for parts lost, damaged, or destroyed:
Padlock, 41.00,•' key, 50¢'; meter hood, $3.50. In the event said
meter hood, padlock and key are surrendered or repossessed in good
condition, and all rentals thereon have been paid; the deposit of
$5.00 on each hood shall be returned to the depositor."
Section 4. Any person who shall violate or fail to comply with any
of the provisions of this code, or who shall counsel, aid or abet any such violation
or failure to comply, shall be deemed guilty of a misdemeanor; and upon conviction
thereof, 'shall be punished by a fine in any sum not exceeding misdemeanor;, Hundred ($300.00)
Dollars, or by imprisonment in the City Jail for a term not exceeding ninety (90) days;
or both such fine and imprisonment.
Section 5. This ordinance is one to provide for the immediate
preservation of public peace, property, health and safety of the people of the City of
Yakima; an emergency is hereby declared to exist; and said ordinance shall be in full
force and effect from and after the date of its passage, approval and publication as
provided for in the City Charter.
