AN ORDINANCE re- zoning Lots 46 and 47, and a portion of Lot 48, Cherry Avenue Subdivi sion; more particularly described as follows: Beginning at the Northeast corner of Lot 46, Cherry Avenue Subdivision; thence West along the North line of Lot 46 and 47 to the Northwest corner of Lot 47; thence South along the East line of the alley a distance of 120 feet; thence East par- allel with Poplar Street 170 feet to the West line of Third Avenue North; thence North along said West line 120 feet to the point of beginning; from "C" Residence District to Commercial District. WHEREAS, the City Commission has duly considered the re- zoning of the premises named in caption hereof, which are situated in the City of Yakima, Yakima County, Washington; which said premises are now "C" Residence District, to Commercial District; and it appearing that the Yakima Planning Commission has approved and recom- mended - such. change; and there having been conducted a public hearing•upon•the matter; and it appearing to be for the best interests of the City of Yakima to so re -zone said premises; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described property, situate in the City of Yakima, Yakima County, Washington, to -wit :_ Lots 46 and 47, and a portion of Lot 48, • Cherry Avenue Subdivision; more particularly described as follows: Beginning at the Northeast corner of Lot 46, Cherry Avenue Subdivision; thence West along the North line of Lot 46 and 47 to the Northwest corner of Lot 47; thence South along the East line of the alley a distance of 120 feet; thence East parallel with Poplar Street 170 feet to the West line of Third Avenue 1 Vorth; thence North along said West line 120 feet to the point • of beginning; be and the same hereby is re -zoned to a Commercial .District classification. • Section 2. The above change in zoning shall be included in and depicted upon the next regularly amended height, area and use district maps, prepared by and for the City. All of the limitations on use and height provided for commercial dis- tricts by the General Zoning Ordinance of the City of Yakima, the same being Ordinance No. B -293, and amendments thereto, are hereby declared to apply to and govern the property described herein, from and after the effective date of this Ordinance. The limitations upon area for said property, as provided by said General Zoning Ordinance, shall remain as the limitations provided for the Fourth Area District,_as described. thereunder. Section 3. This Ordinance shall become effective 30 days after its passage, approval and publication as provided by law and the City Charter.
