B -1239 AN ORDINANCE providing for the improvement of the alley in Block 272, Kers Addition in the City of Yakima, Washington, by grading and paving with Portland cement concrete; and also for the improvement of the alley in Block 1, Pioneer Addition; the alley in Block 93, Yakima and a portion of the alleys between Chicago Avenue and 15th Avenue North, extending from West Yakima Avenue to West "A" Street, by grading and paving with asphaltic concrete on a gravel base; establishing a Local Improvement District, providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIIVA: Section 1. That the alley in Block 272, Kers Addition, shall be improved by grading and paving with Portland Cement concrete; that the alleys in Block 1 Pioneer Addition, Block 93 Yakima, and a portion of the alleys between Chicago Avenue and 15th Avenue North, extending from West Yakima Avenue to West "A" Street shall be improved by grading and paving with asphaltic concrete on a gravel base, all in accord- ance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. Section 2. There is hereby created and established a Local Improvement District to be called Local Improvement District No. 719 which said district is to include the property described as follows: All lots in Block 272 Kerrs Addition, Block 1 Pioneer Addition, Block 93 Yakima, Block 430 Nichols Capitol Heights Addition; Lots 1 -6 inclusive in Biehns Addition; Lots 19 -24 inclusive, Washington Square; Lots 4 -18 inclusive, Nob Hill Addition. Section 3. All of the costs and expenses in connection with the making and construction of said improvement, including the cost andexpense of all engineering, inspection, advertising, publication of notices, and all other expenses incident there- to, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and said City shall not be liable in any manner for any portion of said costs andexpenses of said improvement. Section 4. All of the aforesaid construction work shall be in accordance with the plans, profiles, specifications, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract upon competitive bids, and the City shall have the right and power to reject any and all bids. Section 6. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 719 "; into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon; and in the event of the sale of Local Improvement Bonds by this City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said dis- trict, payable in 10 equal annual installments, with interest at the rate of 4 per cent 1/ per annum, interest payable annually, under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City., of Yakima. Section 8. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by City Charter.
