ORDINANCE NO. B -1236
AN ORDINANCE providing for the'improvement of certain property by grading, ballasting,
surfacing and constructing concrete curbs and gutters; establishing a
Local Improvement District; providing for the method of payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Maclaren Street from 23rd Avenue South to 24th Avenue
South, shall be improved by grading, ballasting, surfacing and constructing concrete
curbs and gutters; and to be constructed in full accordance with the plans and speci-
fications prepared by the City Engineer and filed with the City Clerk. The property
to be benefited by this improvement consists of the following:
Beginning at the intersection of Maclaren Street and 24th Avenue South;
thence Northerly along 24th Avenue South to a point midway between
Maclaren Street and Tieton Drive; thence Easterly and parallel with
Tieton Drive to 23rd Avenue South; thence Southerly along 23rd Avenue
South to a point 312 feet South of the South line of Maclaren Street;
thence Westerly and parallel with Maclaren Street to 24th Avenue South;
thence Northerly along 24th Avenue South to the point of beginning.
Section 2. There is hereby created a Local Improvement District to be
called Local Improvement District No. 718; which said district shall include all of
the property described and set forth in Section 1 hereof.
Section 3. All of the cost and expense in connection with the making
and construction of said improvement, including the cost and expense of engineering,
inspection, advertising, publication of notices and all other expenses incident
thereto, shall be levied and assessed upon all of the property embraced within said
Local Improvement District in accordance with the special benefits conferred thereon,
in the manner provided by the laws of the State of Washington and the ordinances of
the City of Yakima; and said City shall not be liable in any manner for any portion
of said cost and expense of said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, profiles, specifications, maps and detailed drawings which have been
prepared by theCity Engineer, filed with the City Clerk; and which are hereby
approved and adopted.
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund, to be called "Local
Improvement Fund, District No. 718 ", into which shall be placed all sums paid on
account of the aforesaid special assessments, including all interest and penalties
thereon; and, in the event of the sale of Local Improvement Bonds by this City, all
premiums and interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 per cent per annum,
payable on or. before 12 years from date of issuance, shall be issued in payment of
the cost andexpense of s aid improvement; which bonds shall be redeemed by the collect-
ion of special assessments to be levied and assessed upon the property within said
district, payable in 10 equal annual installments; with interest at the rate of 4 per
cent per annum, interest payable annually; under the mode of "payment by bonds" as
defined by the statutes of the State of Washington and the ordinances of the City of
Yakima.
Section 8. This ordinance is one relating to local improvements or
assessments therefor; and shall become effective immediately upon its passage,
approval and publication as provided by City Charter.
PASSED BY THE CITY COMMISSION, signed and approved, this 9th day of
April, 1951.
