B -1227 AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington by constructing an irrigation system to serve various lots and tracts of land; establishing a Local Improvement District; providing for the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That an irrigation system shall be constructed to serve all the lots and tracts of land included within the following described district: Beginning at the intersection of 35th Avenue South and Tieton Drive; thence Westerly along Tieton Drive to the West line of South Glenn Drive Tracts; thence northerly along said West line to West Walnut Street; thence Easterly along West Walnut Street to 35th Avenue South; thence Southerly along 35th Avenue South to the point of beginning. Said improvement to consist of the installation of the necessary mains, laterals, ser- vice connections and other appurtenances for the purpose of delivering water for irrig- ation purposes to each lot and tract of land within the proposed district. Section 2. There is hereby created and established a Local Improvement District, to be called "Local Improvement District No. 715 ", which said district shall include all of the property described and set forth in Section 1 hereof. Section 3. All of the cost and expense in connection with the making and construction of said improvement, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in accordance with the special benefits conferred thereon; in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and said City shall not be liable in any manner for any portion of said cost and expense of said improvement. Section 4. All of the aforesaid construction work shall be in accordance with the plans, profiles, specifications, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 5. All of the work necessary to be done in connection with the making of said improvement shall be done by and made by contract upon competitive bids, and said City of Yakima shall have and reserves the right to reject any and all bids. Section 6. There is hereby created a special fund to be called "Local Improvement District Fund, District No. 715 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penal- ties thereon; and in the event of the sale of Local Improvement Bonds by said City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before'l2 years from the date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the coll- ection of special assessments to be levied and assessed upon the property within said district, payable in 10 equal annual installments, with interest at the rate of 4 per cent per annum, interest payable annually, under the mode of "Payment by Bonds ", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assess- , ments therefor, and shall become effective immediately upon its passage, approval and publication as provided by City Charter.
