B -1221 AN ORDINANCE providing for the improvement of property in the City of Yakima, Washing- ton, by the construction of a sewer; establishing a Local Improvement District; providing for the method of payment therefor; and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKI MA : Section 1. That property in the City of Yakima, Washington, shall be im- proved by the construction of a pipe sewer with the necessary wye branches, manholes, flush tanks and water connections therefor; all which property is hereinafter more part- icularly described in Section 2 hereof; and by doing all such other work as may be necessary in connection therewith; all in accordance with the plans and specifications therefor prepared by the City Engineer, passed, approved and on file with the City Clerk. Section 2. There is hereby created and established a local improvement district to be called "Local Improvement District No. 714 "; which said district is described as follows: . Beginning at the Northeast corner of the intersection of Grandview Avenue and Lincoln Avenue:;.. thence Northerly along the East line of Grandview Avenue a distance of 740.8 feet; thence Easterly 632.8 feet to the East line of the West Half of the Northwest Quarter of the Northwest Quarter of Section 23, Township 13 North, Range 18, E.W.M.; thence Southerly along said East line to the Naches & Cowiche Canal; thence Southerly and Wester- ly along said canal to the North line of Lincoln Avenue; thence Westerly along said North line to the point of beginning. Section 3. All of the costs and expenses in connection with the making and construction of said improvement, including the cost and expense of all engineering, inspection, advertising, publication of notices, and all other expenses incident there- to, shall be levied and assessed upon all of the property embraced within said Local improvement District; in accordance with the special benefits conferred thereon in the manner provided by the laws of the State of Washington and the ordinances of the City of Yakima; and said City shall not be liable in any manner for any portion of said costs and expenses of said improvement. Section 4. All of the work necessary to be done in connection with the making of said improvement shall be done by and made by contract upon competitive bids; and said City of Yakima shall have and reserves the right to reject any and all bids. Section 5. There is hereby created a special fund, to be called "Local Improvement Fund District No. 714 ", into which shall be paid all sums paid on account of the aforementioned special assessment, including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City, all premiums and interest onsaid bonds issued for said improvement. Section 6. Bonds bearing interest at the rate of 4 per cent per annum, payable on or before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said dis- trict, payable in 10 equal annual installments, with interest at the rate of 4 per cent per annum', interest payable annually under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. Section 7. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by City Charter.
