ORDINANCE NO. B -1190
AN ORDINANCE relating to, regulating and licensing the business of merchant patrolman,
defining such business, and fixing an effective date.
BE IT ORDAINED BY TIIE CITY OF YAKIMA AS FOLLOWS:
Section 1. For the purposes of this ordinance, the term "merchant
patrolman" is defined to mean a person who, for hire or reward, as a business, and as
an independent contractor, guards or protects persons or persons' property, or
patrols streets, districts or territories for such purposes, and includes any person
who is employed as a guard or patrolman for any such person.
Section 2. After December 1, 1950, it shall be unlawful for any person,
firm or corporation to be or become a merchant patrolman or to solicit business as a
merchant patrolman without being the holder of a valid and subsisting license issued
under the provisions of this ordinance, such license to be designated as "Merchant
Patrolman's License ". The fee for such license shall be $25.00 per year. All
licenses shall expire on the 31st day of October of each year, and no reduction in
fee for such licenses shall be made for any partial year.
Section 3. No Person shall be granted a merchant patrolman's license un-
less he meets :the 'following qualifications:
(a) He shall be a citizen of the United States.
(b) He shall not have been convicted of a crime involving moral
turpitude.

(c) He shall be thoroughly familiar with the City of Yakima and, to
insure such familiarity, shall have been a resident of the County
of Yakima for at least one year prior to the application for such
- - license.
('d) He shall be either a special deputy of Yakima County Sheriff's
office or a special policeman of the !City of Yakima.
( e) He shall be a person of honesty, integrity and good moral
character and, to insure provisions of this sub - division, shall
at the time of applying for such license, furnish a letter or
statement signed by two freeholders of the County of Yakima to
the effect that they have known applicant for at least one year
prior to such application and that he is a person of good moral
character and that his reputation for honesty and integrity is
good.
(f) The fingerprints of such applicant shall be on file with the Police
Department of the City of Yakima.
Section 4. At the time of applying for such license, applicant shall
pay to the City Clerk the sum of 425.00, and shall also furnish and deliver to said
City Clerk a statement of the Chief of Police or of the Yakima County Sheriff's
office showing that applicant is either a special deputy or special policeman, as the
case may be. Applicant shall also deliver to such City 'Clerk the letter'hereinbefore
required, and a statement from the custodian of fingerprint records of the City of
Yakima stating that applicant has been fingerprinted.
Section 5. Each merchant patrolman shall -at all times while engaged in
the pursuit of such occupation carry with him a full and complete list of all proper-
ties he is hired to protect or patrol and, in the case of guard, the person or
persons he is hired to protect. Such list shall be submitted to the inspection of
any authorized peace officer of the City of Yakima or of the County of Yakima upon
request. In addition such merchant patrolman shall also deposit with the Chief of
Police of the City of Yakima a duplicate list of such property and /or persons, and
upon his being hired to protect any additional persons or properties or upon his
ceasing to protect any persons or properties shall, within one week thereafter,
revise such list with said Chief of Police.
Section 6. The license herein required may at any time be revoked by
the City Commission upon the conviction of the holder thereof of a crime involving
moral turpitude or on conduct of the holder detrimental to the preservation of peace
and order in the City of Yakima. The holder of such license shall be given ten days'
notice in writing by the City Commission of any such forfeiture, and upon the deter-
mination by said City Commission that the holder of such license is no longer a fit
and proper person to conduct such business as defined in this section, such license
shall thereupon be revoked.
Section 7. Ilnyone violating this ordinance shall be guilty of a misde-
meanor and fined not to exceed Three Hundred Dollars (4300.00) or imprisoned in the
city jail for a time not to exceed ninety (90) days, or both.
Section 8. This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval, and publication as provided by law.
