HomeMy WebLinkAbout1950-B-1178 162 ORDINANCE NO. 9-1178 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing a Local Improvement District, providing for .the method of payment therefor, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That 34th Avenue North from Summitview Avenue to Jefferson Avenue, in the City. of Yakima, shall be improved by grading, ballasting, surfacing and constructing concrete :curbs and gutters, and to be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. The property to be benefited by this improvement consists of the following: Beginning at a point on the North line of Summitview Avenue, midway between 34th. Avenue forth and 35th Avenue North; thence Northerly along a line midway between 34th Avenue North and 35th Avenue North to Jefferson Avenue; thence Easterly along Jefferson Avenue to the Northeast corner of Lot 9, Block 1, Flagg Addition; thence Southerly along the Easterly lines of Lot 9, Block 1, Flagg Addition; Lots 6 -10 inclusive, Replat Shuman Addition, and Lots 1 -5 inclusive, Rice's Plat to the North line of Summitview Avenue; thence Westerly along said worth line to the point of beginning. Section 2. There is hereby created a Local Improvement District to be called Local Improvement District No. 707, which said district .shall include all of . the property, described and set forth in Section 1 hereof. Section 3. All of..the cost and expense in connection with the making and construction of said improvement, including the cost and expense of engineering, inspection, advertising, publication of notices and all other expenses incident there- to, shall be levied and assessed upon all of the property embraced within said Local Improvement District in accordance with the special benefits conferred thereon, in the manner provided by the laws of the State of Washington and the Ordinances of the City of Yakima; and said City shall not be liable in any manner for any portion of said cost and expense of said improvement. Section 4. All of the aforesaid construction work snail be in accordance with the plans, profiles, specifications, maps and detailed drawings which have been prepared by the City Engineer filed with the City Clerk, and which are hreby approved and adopted. • Section 5. All of the work necessary to be done.in connection with the making of said improvement shall be done and made by contract upon competitive bids; and the City shall have the power to reject any and all bids. Section 6. There is hereby created a special fund, to be . called . "Local • Improvement Fund, District No. 707 ", into.wtiich shall be placed all sums paid on account of the aforesaid special assessments; including all interest and penalties thereon; and, in the event of the sale of Local Improvement Bonds by this City, all premiums and interest on said bonds issued for said improvement. Section 7. Bonds bearing interest at the rate of 4 per cent per annum, payable on or. before 12 years from date of issuance, shall be issued in payment of the cost and expense of said improvement; which bonds shall be redeemed by the coll- ection of special assessments to be levied and assessed upon the property within said district, uayable in 10 equal annual installments, with interest at therate of 4 per cent per annum, interest payable annually, under the mode of "payment by bonds" as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima. Section 8. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval andpublication as provided by City Charter.
