ORDINANCE NO. B-1169 •
AN ORDINANCE providing for the improvement of certain property by grading, ballasting,
surfacing and constructing concrete curbs and gutters; establishing a
Local Improvement District, providing for the method of payment therefor,
and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Broadway Avenue from West Pine Street to Lenox Avenue,
in the City of Yakima, shall be improved by grading, ballasting, surfacing and con-
structing concrete curbs- and gutters, and to be constructed in full accordance with
the plans and specifications prepared by the. 'City Engineer and filed with the City
Clerk. The property to be benefited by this improvement consists of the following:
Beginning at the intersection of Broadway Avenue and West Pine
Street; thence Easterly along West Pine Street to the Northeast'
corner of Block 235, Lund +s Addition; thence Southeasterly and
Southerly parallel with Broadway Avenue to Lenox Avenue; thence
Westerly along Lenox Avenue to a point 120 feet West of the West
line of Broadway Avenue; thence Northerly and Northeasterly
parallel with Broadway Avenue. to West Pine Street; thence East-
erly along West Pine Street to the point of beginning.
Section 2. There is hereby created a Local Improvement District to be
called Local Improvement District No..•704, which said district shall include all of
the property described and set forth in Section 1 hereof.
Section 3. All of the cost and expense in connection with the making
and construction of said improvement, including the cost and expense of engineering,
inspection, advertising, publication of notices and all .other expenses incident there-
to, shall be levied and assessed upon all of the property embraced within said Local
Improvement District in accordance with the special benefits conferred thereon, in the
manner provided by the laws of the State of Washington and the Ordinances of the City
of Yakima; and said City shall not be liable in any manner for any portion of said
cost and expense of said improvement.
Section 4. All of the aforesaid construction work shall be in accord-
ance wt th the plans, profiles, specifications, maps and detailed drawings which have
been prepared by the City Engineer, filed with the City Clerk and which are.hereby
approved and adopted.

Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids,
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be .called "Local
Improvement Fund, District No. 704, into vich shall be placed all sums paid on
account of the aforesaid special assessments, including all interest and penalties
thereon; and, in the event of the sale of Local Improvement Bonds by this City, all
premiums and interest on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4 percent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of
cost and expense of said improvement; which bonds shall be redeemed by the collection
of special assessments to be levied and assessed upon the property with said district,
payable in 10 equal annual installments, with interest at the rate of 4 per cent per
annum, interest payable annually, under the mode of "payment by bonds" as defined by
the statutes of the State of Washington and the Ordinances of the City of Yakima.
Section 8. This ordinance is one relating to local improvements or.
assessments therefor, and shall become effective immediately upon its passage,
approval and publication as provided by City Charter.
