ORDINANCE NO. B -1168
•
AN ORDINANCE amending Ordinance No. B -648, entitled "AN ORDINANCE providing for the
licensing and regulation of certain mechanical devices commonly known
as "juke boxes ", providing penalties for the violation hereof, and fixing
the effective date of this Ordinance "; as amended by Ordinances No. B -719,
B - 7 2 3, B-779, and B -1027; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1.. That Ordinance No. B -648, passed and approved by the City
Commissioh on the 23rd day of June,,1945, and entitled as set forth in the caption
hereof, and its amendments by B -719, passed and approved by the City Commis-
sion on the 8th day of July, 1946, and by Ordinance B -779, passed and approved by the
City Commission on the 28th .day of April,-1947,and by Ordinance B -1027, passed and ap-
proved by the City Commission on the llth day of.July, 1949; be and the same is hereby
amended to read as. follows:
"Section 1. For the purpose of this ordinance the term "Juke Box" shall
in addition to its usual and ordinary mean and include any machine or device
designad to be operated so as to.produce.music by the insertion or deposit of a coin
or token or other thing of value.
Section 2. It shall be unlawful for any person, firm, corporation,_co-
partnership or club within the City limits of Yakima, Washington,.to maintain,. operate
or permit to be operated or placed with others for the purpose of use, play or opera-
tion any Juke Box without having a,valid and - subsisting license for the operation of
such Juke Box, designated as "Juke Box License.- separate license shall be required
for each Juke Box and said license shall designate the location at which said Juke Box
is to be operated. The City Clerk shall prescribe the form-of Juke Box License •.
Section 3. he annual license fee for a Juke Box license shall be $5.00
per year, payable on or before the let day of July.of•each year, commencing July 1,
1950. In the event that such license shall be surrendered or revoked for cause, .no
part of the license free shall be refunded. The license herein provided for shall not
be transferrable from one person to another, or from one location to another, or from
one Juke ' to another -.
Section 4. Any license issued pursuant to this 0 rdinance may be revoked
or suspended for cause by the City Commission. Any licensee whose license is revoked
or suspended shall' have the right to a hearing before the City Commission by filing
with the City Clerk a written request therefor within five (5) days after the entry of
the order of revocation or suspension-. The application for hearing shall specify an •
address at which the licensee may be given notice of the time of such hearing. At the
hearing the licensee shall be entitled to appear in person and offer evidence pertinent
to the revocation or euspension,'and the City shall likewise be entitled to offer
evidence• in'support of 'its order of revocation or suspension.. Suspension or revocation
shall be by resolution of the City Commission and a copy immediately mailed to the
licensee at his last known address. .

Section 5. Any violation or failure to comply with the of this
ordinance shall constitute a misdemeanor and upon conviction thereof shall subject the
offender to a fine in any sum not exceeding Three Hundred Dollars 0300.00) or
ment in the City Jail for •a period not exceeding ninety (90) days, or both such fine
and imprisonment.
Section 6. Said Juke Boxes shall at all times be so operated, supervised
and controlled so as not to constitute a nuisance and so as not to unduly annoy and
disturb others.

Section 7. This ordinance is one to provide for revenue police
supervision,. and is necessary for the protection of th.e public health, peace, property,
safety and welfare of the people of the City' of. Yakima; and an emergency is hereby
declared to exist; and this ordinance shall be in effect immediately upon its passage,
approval and publication. as provided by law and the City Uharter.
