ORDINANCE NO, B -1157
AN ORDINANCE for the improvement of the alleys in Blocks 112,-.Yakima; 148,
Eastern Addition; 411, .Capitol Addition; 13, 14 and 15, Milroy's Plat;
between 25th Avenue South and 26th Avenue South from Tieton Drive to West
Walnut Street and the alley immediately west of the east half of Lot 7 of
Allan's Acre Tracts; by grading and paving the same with asphaltic concrete
placed on a gravel,base; establishing a Local Improvement District, pro-
viding for the method of payment therefor, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the alleys in Blocks 112, Yakima; 148, Eastern Addition;
411,,Capitoi Addition; 13,..14 and 15, Milroy's Plat; between 25th Avenue South and 26th
Avenue South from Tieton Drive to West Walnut Street and the alley immediately west of
the east half of Lot 7 of Allan's Acre Tracts; shall improved by grading and paving
the same with asphaltic concrete placed on a gravel base, to be constructed in full
accordance with . the plans and specifications prepared by the City Engineer and filed
with the City Clerk. .
Section' 2. There_is hereby created and established a Local Improvement
District to be called "Local Improvement District No.- which said district is
described as follows.; .
•
All the lots in Blocks 112, Yakima; 148 Eastern Addition; 411, Capitol
Addition; and 13, 14 and 15, Milroy's Plat; Lots 1 to 12, inclusive,
Terrace Addition; Lots 1 to 12, inclusive, Block 1, Tieton,Terrace
Addition; Lots 1 to 5 inclusive, Block 1, Allan's :Subdivision; and the
West 103 feet of Lot 6 and the East half of Lot 7 of Allan's Acre Tracts.
Section 3. All of the costs•and expenses in connection with the making
and construction of said improvement, including the cost and expense of all engineering,
inspection, advertising, publication of notices, and - all others. expenses incident there-
to shall be levied, and assessed upon all of the property embraced within said Local
Improvement District in accordance with the special benefits conferred thereon in the
manner provided by the Laws of the State of Washington and the Ordinances of the.City
of Yakima; and said City shall not be liable in any manner for any portion of.said
costs and expense of.said improvement. •
Section 4. All of, the abresaid construction work shall be in accordance
with the plans, profiles, specifications, maps,and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk and which are hereby approved
and adopted. .
Section 5, All of the work necessary to be done in connection with the
making of • said improvement shall be dne and made by contract upon competitive bids
and the City shall have the right and power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 700 "•into which shall be placed all sums paid•on
account of the 'aforesaid special assessments, including all interest and penalties
thereon; and in the event of the sale of Local Improvement Bonds by this City, all
• premiums and interest on said bonds issued for said improvement.
Section 7.. Bonds bearing•interest at. the rate of 4 per cent per annum,
payable on or before 12 years from date of issuance, shall be issued in payment of the
cost and expense of said improvement; which bonds shall be redeemed by the - collection
of special assessments to be levied and assessed upon the property within said district,
payable in 10 equal annual installments, with interest at the rate of 4 percent per
annum, interest payable annually, under the mode "payment by bonds" as defined by.the
statutes of the State of Washington and the ordinances of the City of Yakima; .
• Section S. This ordinance is one relating•to local.imprbvements,or
assessments therefor and shall become effective immediately upon its passage, approval
and publication as provided by City Charter.

1950.
