ORDINANCE NO. B_1587
AN ORDINANCE providing for the improvement of certain property by grading, ballasing,
surfacing and constructing concrete curbs and gutters; establishing a Local
Improvement District, providing for the method of payment therefor, and
creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That 35th Avenue North from Summitview Avenue to Lincoln Avenue;
111 Jefferson Avenue from 35th Avenue North to Grandview Avenue; and 34th Avenue North from

! Jefferson Avenue to Lincoln Avenue shall be improved by grading, ballasting, surfacing

and constructing concrete curbs and gutters, and to be constructed in full accordance
with the plans and specifications prepared by the City Engineer and filed with the City
Clerk. The property to be benefited by this improvement consistes of the following: -'
Beginning at the intersection of the west line of 35th Avenue North with
the north line of Summitview Avenue; thence westerly along the north
line of Summitview Avenue to a point 11$ feet east of the east line of
• North Hillcrest Avenue; thence northerly and parallel with the east line
of North Hillcrest Avenue to Lincoln Avenue; thence easterly along Lincoln
Avenue to a point 120 feet east of the east line of 34th Avenue North,
said point being the northeast corner of Lot 21, Block 1, of Flagg Addi-
tion; thence southerly along the east line of said Lot 21 a distance of
130 feet; thence easterly and parallel with Jefferson Avenue to 32nd
Avenue North; thence southerly along 32nd Avenue North to a point 130
feet south of Jefferson Avenue, said point being the southeast corner of
Lot 1, Block 1, of Flagg Addition; thence westerly and parallel with
Jefferson Avenue to the northeast corner of Lot 9, Shuman Addition;
thence southerly along the east line of Lots 9 and $ of Shuman Addition,
the easterly line of Lots 19, 1$, 17, and 16, Replat of Shuman Addition
and the east line of Lots 4, 3, 2 and 1 of Shuman Addition to the north
line of Summitview Avenue; thence westerly along said north line to the
point of beginning.
Section 2. There is hereby created a Local Improvement District to be call-
ed Local Improvement District No. 7$1, which said district shall include all of the prop-
. erty described and set .orth In Section 1 hereof.
Section 3. All of the cost and expense in connection with the making and
construction of said improvement, including the cost and expense of engineering, inspec-
tion, advertising, publicationof notices and all other expenses incident thereto, shall

be levied and assessed upon all of the property embraced within said Local Improvement
District in accordance with the special benefits conferred thereon, in the manner and as
provided by laws of the State of Washington and the Ordinances of the City of Yakima,
and said City shall not be liable in any manner for any portion of said cost and expense
r df said improvement.
Section 4. All of the aforesaid construction work shall be in accordance
with the plans, specifications, profiles, maps and detailed drawings which have been
prepared by the City Engineer, filed with the City Clerk, and which are hereby approved
and adopted. .
Section 5. All of the work necessary to be done in connection with the
making of said improvement shall be done and made by contract upon competitive bids;
and the City shall have the power to reject any and all bids.
Section 6. There is hereby created a special fund to be called "Local
Improvement Fund, District No. 7$1 ", into which shall be placed all sums paid on account
of the aforesaid special assessments, including all interest and penalties thereon; and,
in the event of the sale of Local Improvement Bonds by this City, all premiums and inter-
est on said bonds issued for said improvement.
Section 7. Bonds bearing interest at the rate of 4% per annum, payable on
or before 12 years from the date of issuance, shall be issued in payment of the cost and
expense of said improvement; which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said district, payable in
10 equal annual installments, with interest at the rate of 4% per annum, interest payable
annually, under the mode of "Payment by Bonds ", as defined by the statutes of the State
of Washington and the Ordinances of the City of Yakima.
Section E. This ordinance is one relating to local improvements or assess-
ments therefor, and shall become effective immediately upon its passage, approval and
publication as provided by the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 10th day of August,
1954.
